Council Tree Damaged My fence

Theres a big tree at the bottom of my back garden thats on a public bit of green. It over hangs my garden and for a few years now the trunk and branches are leaning into my garden. I dont mind the branches that over hang but the tree trunk and one particular branch is now in a position where it has bust the fence.
I could replace the panel but it would be pretty hard work getting it in between the concrete pillars with the tree overhanging.

I was just wondering if the council would have to remove the tree or at least cut the branches that are causing the problem?
Or can i in a fit of rage remove the offending branches myself and just leave them by the tree.

    Trees in certain areas have TPO's on them and there are heavy penalties for cutting them, even branches .Every tree that my Son works on has to be checked just in case.I would contact the council.

    If it is the councils tree, you could claim of their insurance for the replacement panels, also this way they are more likely to do works on the branches to stop it happening again and costing them more money.

    The local planning authority is responsible for TPO's but if you are claiming off the council just contact their local workshop or office and ask which is the right department.
