Ebay - Problem with Selller

Hi
I'm after some advice please
I bought an item from a seller with an estimated delivery date of 4-5 days which was paid for immediately on 12th July.
I contacted the seller after 5 days to query delivery and mentioned it wasnt showing as dispatched. I received an email a day later saying it would be delivered the following day, Thursday 19/7, - it wasnt and the status still wasnt updated to show as dispatched.
I got back in touch on the Saturday to say it hasnt arrived and got a cheeky reply telling me how unreasonable I was chasing this up and that she would check with Royal Mail. By Monday night I'd heard nothing so reported non receipt through ebay.
I then received another email telling me how petty I'm being and that she cant be bothered dealing with me so will issue a refund - not yet received. She also said the package had ended up in Russia - would Royal Mail even be able to give that info for an item posted standard 1st class?
Last night she updated the dispute in ebay saying the parcel will arrive on 10th July 2012 - I didnt even pay for the item until the 12th July but cant see how to escalte this in ebay - can anyone help?

talking nonsense.
As soon as sellers come out with lines that they will "check with RM"
alarm bells should ring.
whilst its possible for a york of items to get misrouted out of the UK,its unlikely and not something RM could then tell a customer was where their 1st class packet was.
sounds like it was never sent0 -
The only other way a seller would know where the parcel ended up was if they made a mistake & posted it to a different buyer, who then let them know of the error.
In which case the seller is still at fault.0 -

See a theme? Close the dispute saying not arrived, and ebay will refund your cash, and ebay'll get it off her.
Ignore any communication from her from here on.Exclamation and question marks - ONE exclamation mark or question mark is sufficient to exclaim or ask about something. More than one just makes you look/sound like a prat.
Should OF, would OF. Dear oh dear. You really should have, or should've listened at school when that nice English teacher was explaining how words get abbreviated.0 -
Thanks folks
I can honestly say I've never dealt with someone so unreasonable in Ebay before. I would bend over backwards for someone who'd paid me in good faith and hadn't received their package.
The dispute status is Take Action but only options are add a message to the seller or close the case if I'm satisfied - which I'm not so do I simply wait until it lets me escalate?0 -

Yes whatever you do don't close the dispute.
I am not familiar with ebay disputes, but if it says it can be escalated at a later date, then leave it until then and escalate it.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. It's about 7 days before you can escalate an Ebay INR case.0
