Help please - car accident

Not sure if this is the place to post this but it seems the most relevant. Anyway long story short my car was parked outside work, a car broke down and was pushed into my car. luckily a colleague saw and i managed to get there and speak to the guy. He gave me the details and i phoned my insurance company. later that day he phoned me telling me that his insurance declared it void as hisgf was in the drivers seat at the moment and he was willing to pay for it. I ( i dont know anything about car insurance) decided that was the best idea. i went round myself and got the quotes, offered to pass on details of the garages, which he refused. The garage i found that was cheapest had no card machine ( he was borrowing his mothers card to pay for it) so i had to pay for it as the electrics were damaged and i couldn't use the driver door properly. i begrudgingly agreed for him to pay in instalments ( im a sucker, what can i say?) however he is now making this very hard, telling me he wants me to sign a solicitors letter to say that when he gives me the money i wont go on to reopen the claim with my insurers. tbh i dont know what to do, i've given them now around 2 months and have recieved no money at all and am out of pocket more than a months wages. if anyone has any ideas......:(

    Claim against his insurance. Use the legal cover on your policy to sue him if he doesn't pay. You have up to 6 years to put in a claim.

    The fact his GF was technically driving it at the time isn't your problem. His insurance will pay you out then go for him for the money.

    As per above poster, the Road Traffic Act means the Insurers of his car are obliged to pay out even if the girlfriend was not on his policy.

    Either go direct to them (You can find his policy number, name of Insurer and their tele number here for a small charge https://www.askmid.com ) or tell him if he does not start paying immediately you will go.

    Personally I would go with option one, let his Insurers chase him up for the money rather than you wasting your time

    Ask to see the document first, if it's full of jargon or lengthy run a mile, if it's a very basic disclaimer then sign the form and exchange money at the same time. If you can sort it out with little more hassle then do it, but if the document is lengthy or confusing in any way or form then let the professionals deal with it.

    You have been more than decent with him. Two months is a pish take and you know it. Demand payment, in cash, in full within 48 hours and you will sign a receipt saying it is in full and final settlement of the damages that he is entirely responsible for. Otherwise the claim is going to be properly processed and his "gf" and him can work out what other costs and criminal liabilities they have set themselves up for.
