****dy tax credits

HI, CAN ANYONE HELP? SPLIT WITH EX SEPT 2005, I SENT OFF THEN AND HAVE DONE SINCE ALL MY TAX FORMS, JUST HAD CALL SAYING THAT I/WE OWE £300. APPERENTLY HE NEVER RETURNED HIS FORMS. SO THEY PAID US TWICE, FROM THE PERIOD OF SEPT 2005-APRIL 2006. HOWEVER I WAS GETTING MY PAYMENTS IN THIS TIME, SO I CAN ONLY GATHER HE MUST OF BEEN GETTING THEM TOO. I QUERIED AS TO WHY I WAS LIABLE AS I HAD DONE EVERYTHING CORRECT, INFORMED THEM OF HIM LEAVING, FILLED FORMS IN ETC. THEY SAID BECAUSE THE ORIGINAL CLAIM WAS STILL IN BOTH OUR NAMES UP TILL APRIL 2006. I DON'T GET IT, I TOLD THEM IN THE SEPT HE WASN'T HERE ANYMORE, I FILLED THE DAMN FORMS IN ETC, NOT MY FAULT HE DIN'T, YET BECAUSE HE FAILED I AM STILL LIABLE. THEY SAY THEY WILL SEND BAILIFF, CHARMING AS HE'S NOT EVEN HERE, SO ONCE AGAIN, IT WILL BE DOWN TO ME.
I EVEN OFFERED TO PAY OFF MY HALF AT £5 A MONTH, THEY AGREED BUT THEN SAID IF HE DIDN'T PAY HIS HALF I WOULD STILL BE LIABLE ANYWAY.
HOW CAN I SUFFER WHN I DID EVERYTHING RIGHT? I REALLY DON'T UNDERSTAND, WHY DIDN'T THEY STOP PAYIMG HIM WHEN I INFORMED THEM OF EVERYTHING, SURELY THATS UP TO THEM, THIS SIS THEIR MISTAKE AND HIS, NOT MINE IV'E GONE BY THE BOOK!!!!
PLEASE ADVISE AM DESPERATE:confused:

    Hi Panyanpickle,
    Have you contacted your MP ? He may be able to look into your case for you - its amazing how The Tax credits office sit up and take notice once they get involved.
    As I see it, you informed them of your change of circumstances in september .and now they have made the mistake by not canceling his claim .If he has indead committed fraud by not informing them that he was no longer entitled to tax credits, then is his and the Tax credits problem, not yours!
    Was your Ex getting the tax credits paid into his bank account before the split ? if so,when you informrd them of the change of circumstances did they then start paying them direct to you ? if this is the case you have your proof !

  • Hi, the bank account that it got paid into was in BOTH our names still, although i wasn't using it!!!! And yes when i informed them, they was making the payments direct to me, thats where they say the over payment is,hence to them it looks like IVE received the payment twice as initially a joint claim.
    How do i go about contacting my MP? This is all new to me.

    go to https://www.locata.co.uk/commons . you can then enter your post code and it will give you the name and contact details of your local MP.

    I would ask then to explain why your original joint claim was not cancelled when the change of circumstances was reported to them - did they send you out a new award notice (in your name only) after you informed them that your ex had left ?
  • HI, Thx for link- yes they did send me out new notice in my name only once i had informed them. Thats how they know that its his form they didnt receive back and not mine!!!! Thye already had this query from last year, i was told then to ignore it and i was ok..... 1 yr later........... then now inform me that "yes it was looked into,but a decision has been made and its not their fault" if you plz lol. How can they change their minds from one year to the next?? it beggars belief.:mad: :mad: :mad: :mad:

    From what you say, its all their mistake. you need to make an official complaint to the tax credit office, once you submitted your claim as a single person I'm sure that the original (joint) claim should then have been canceled. If they carried on paying your Ex or he claimed money that he was not entitled to then that should not be your problem or responsibility to pay it back !

    Go to your MP or local welfare rights service, they should both have contact details for the tax credits office departments which have the authority to sort this problem out,unfortunately,the people on the TCO helpline do not have the information/ authority/resources to sort out the more complicated cases.
    If you do need to contact the Tax credits office for any reason, remember to only do it in writing (and keep copies )

    If you have disputed the overpayment can you post the exact wording of their decision on here - just the middle bit with the reason for the overpayment

  • HI PAM 17- the middle bit, the bit they say for overpayment is because it was paid out twice from oct 2005 until april 2006, mine which i get and apperently to the other account too,that was our joint acc.
