Non-compliance fees

Are there any merchants out there that have figured out why we have to pay a non-compliance fee when we do not take card details either by e-mail or over the phone?
Surely the transmission of data from our card machine is the responsibility of the card machine supplier.

Hu? So, you have a MOTO merchant ID by the sounds of it and you are annoyed for paying penalties when you use this for non-MOTO purposes? What are you using it for? Internet? Cardholder Present? CPA? All you need to do is get another merchant ID for the appropriate class of use and thus avoid fees.0
