Hi there

Ive contacted Capital One on four occasions regarding overlimit and late payment charges on my credit card. They ignored all 4 letters; I then rang them and asked them why they had ignored all letters. I received an apology and was told a decision woukd be sent. That of course was a big fat no and labelled final response. So I sent a SAR letter with £10 cheque two weeks ago. Today I receive a remittance advice for £25.21 off them with no explanation what is for. Phoned Capital One who advise £10 cheque not cashed, no record of my SAR request and that this is a goodwill gesture!

Ive told them I want the SAR request done. I know from my MNBA card that I had for a similar amount of time that its going to be in the region of £500+.

Any ideas? It just seems like constant stone walling and delay tactics from them and I am fed up with it..

If you don't want to accept their good will gesture let them know - in writing!

They are obliged, by law, to comply with your SAR request. If they don't you can report them to the Financial Services Authority for non compliance.

Any letters you send in future should be despatched by recorded post, that way you can see whether your letters have been received.
Perhaps you will have to send your SAR letter with another cheque again (by recorded mail) and cancel the first cheque with your bank.

If you don't want to accept their good will gesture write and tell them so.
