Section 75 or Chargeback?

Recently, I purchased 2 electrical items on line from a French supplier that I had used before. The cost of the 2 items is 126Euros which amounted to a charge of £103 on my MasterCard. Despite the Company's Ts and Cs stating that the goods would be despatched within 3 days, the goods have not been sent. When I queried the delay, I was told that the goods would be sent last Thursday. If this was not acceptable, then they would make a refund. I responded stating that I required either confirmation of posting or a refund no later than last Friday. I have received neither and the Company is now not responding to my e-mails. As there are 2 items involved, I am not sure whether I should contact my credit card provider for action under Section 75 or Chargeback? Thanks for any advice.

    If neither is over £100, then section 75 will not apply.

    But if you feel you have exhausted all avenues with the supplier, then contact your credit card provider to see if they are willing to do a chargeback. They may well request you try the retailer again in the first pace though.

    Thanks. I am in daily contact with the Company but he has gone silent and deep. I understand that I have 120 days to inform my card provider so I may just keep pressing. My guess is that he has a supply problem and he just will not admit it.
