Been placed in the work group

Been on incapacity for a number of years and filled out a questionaire to be placed on ESA , i have just got a reply back saying i have been placed in the work related group . It does state that i can only receive this for 365 days so what happens in 12 months then ? So they are expecting me to be fit and well in 12 months ? After 12 months is up if im still not well enough to work can i apply for ESA again ? would i have to start a new claim ?
Really confused as to what being placed in the work related group means ?


I have just been reading a post on here with someone saying they have been on ESA the work related group for a number of years and only been asked to attend a couple of work interviews . I am bit confused as why does my letter say i can only receive ESA for a max of 365 days when this person is saying they have been on it for years ?

    You will be receiving contribution based ESA (not means tested) and have been placed in the work related group.

    After a year you will be assessed for income based ESA if you are still unfit for work. This is assessed on income and savings. If you have a partner who is working/has savings then you are unlikely to be eligible for income based ESA after the year.

    If you feel that you have been put into the wrong group and should be in the Support Group where the year limit does not apply then you can appeal.

    There are descriptors for the Support Group which you would need to meet.

    Thankyou very much for your reply . I dont feel well enough to appeal and i do have a partner who works full time so i wouldnt qualify for income related ESA so i am basically stuck

    You can if you wish do this as a paper appeal - without needing to go to the tribunal.
    This is however less likely to succeed, but if you have a good case - you have evidence you have not sent them, for example, it's worth a shot.

    If you are eligible - meet one of the support group descriptors, then if you do not appeal now, you can't really appeal effectively in the future.
    This is of course if your entitlement to the work-related group is inarguable.

    Not really, unlike some posters on here that have very little money coming in where no one works, you do have an income coming into your household that should be supporting both of you.
