UK CPS - Permit holder

Options
Hello Everyone,

I am a Resident and Permit Holder to a Private Car Park - Residents Only Parking, and have been ticketed more than once as my permit was not visible. I was deemed to be parking Without a Valid permit or Authority! - although I have both.
Researching the website I realise the general rule is to ignore/shred/bin anything that is received from the company. I am looking to complete an oversees visa application which asks 'Have you ever been charged with any offence that is currently awaiting legal action?' - I have received the 10 Day Notice letter (more than 10 days ago now!) and have no idea how to answer this question. Am I to expect any possible court action as a result of this? Or can I declare 'No' and carry on regardless?

Regards

Scorpio

Quite safe to fill in no.

It is not a criminal offence, its a civil matter and of no relivence to the authorities.

Make sure if you go away for any length of time you get your mail redirected to someone you trust like a family member, the last thing you want is if they did decide to take a punt and try court on, if you werent there to submit a defence then they would get judgement against you.

  • Thanks for the advice.
I'm hoping there is some way to resolve this as I am planning to be away for a while and certainly wouldn't like to return to a charge which I would be liable for.

You should make sure not to let the parking company know that you'll be away for a while and under no circumstances should you reveal any information (however insignificant) on here that could identify your real life identity to the parking company as they do read the forums.

In terms of resolving this, I can only refer to muckybutt's post in terms of having mail redirected (or collected from your place if you have family/trusted friends nearby).

Make sure your family/friends know to post either here or on Pepipoo in the unlikely event court papers are received.

If your parking space is included in your deeds/lease, your right to "quiet enjoyment" applies here, just as much as in your home and you would be perfectly entitled to write to your managing/letting agent telling them to instruct these sharks not to ticket/operate over it any more.

And you could give them a rocket for allowing these sharks to operate in the first place too! :)
