Deposit dispute on rented property

Our tenancy ran out on the property we were renting 30.06.12. We followed the check-out procedure given to us and handed our keys in on time. I requested to be present at the final inventory check-out.

The final inventory check-out occured the morning of 03.07.12. Whilst I was there the lady said she was very pleased with the condition of the property and she could see no issues. Later on that day however she phoned and left me a voicemail stating that she hadn't noticed there were some weeds in the yard and they would need dealing with.

As soon as i received this voicemail i rang up the letting company and told them how I wasn't aware that the yard needed to be weed-free as it wasn't stated in the check-out procedure, I also told them that I was more than willing to go back and weed the yard myself. The letting company were very good and said they would phone the landlord and pass this information on to him.

Anyway, a few days went by and I heard nothing so I emailed the letting agency asking if the landlord has replied yet. The letting agency emailed me back first of all saying they were still waiting for a response, and then early the following week they sent me an email saying that the landlord has arranged for a contractor to come in already and it had cost £150 which I was expected to pay out of my held deposit!
Quite understandably I was angry at this considering firstly I had offered to rectify the situation as soon as I realised there was a problem, and secondly, this is an outrageous amount of money to charge seen as the yard is tiny and there is no way the job would have taken more than half an hour with one person doing it!

I phoned the letting agency up straight away saying that I was not prepared to pay £150 and that the maximum I would be prepared to pay was £50 (which is still a lot considering I could have done it myself in under an hour and spent £10 on weed on a decent weed-killer!). They said they would pass on this information to my landlord.

Am i still yet to here back from the letting agency and the landlord, it has been over a week now since I was told he had already arranged for a contractor to come in and ignored my request to come in and sort the issue myself.

Am i right in thinking I have 2 weeks to rectify an issue with a deposit? Am i right in refusing to pay this ridiculous amount of money? For all I know he might not have even had a contractor in and I haven't even seen proof of a bill!

    Do you have an inventory which stats the condition of the garden.

    If there is no dual signed inventory (that you signed) saying 'pristine weed free garden' they have no leg to stand on.

    Go to the place your deposit is lodged (mydeposits, TDS or another one I forget) and claim your deposit back in full asap!

    Stop emailing and start writing letters.

    Unless the check-in inventory shows the yard as weed free at the start of the tenancy, just write and say you've left the property as you found it.

    Request your deposit in full within 2 days. If this is not forthcoming raise a dispute via the deposit scheme.
