ESA waiting for tribunal - what to do with sick notes?

Hi everyone.

I'm appealing against the decision for ESA, and received a letter about 1 week ago saying that they have passed everything onto the tribunal. So i guess I have to wait for a date to be set?

Also just wanted to ask my sick note runs out next week - do I have to send any more? The letter just vaguely states that I "may" need to send more...but this gets me very confused..

    When you appeal the DLA will conduct a reconsideration unless they've already done one. It sounds like that stage has been dealt with, they didn't change their decision and have forwarded papers to tribunals service. The tribunals service should be in touch soon in writing to explain their role and request some details so that they can set up the tribunal. It may take several months for your appeal to actually be heard.

    Normally you are required to send continuous sicknotes to DWP while awaiting appeal in order to continue getting this assessment rate. I would definitely do this... DWP letters at the best of times can be misleading... and if you don't send the sicknotes in you'd probably find out the hard way sadly when your money stops. If you are successful at tribunal then continue sending them in as the DWP will take many weeks (currently 2 or 3 months it seems) to process the result and correct payment/backdate. Once they've done that then you should stop.
