The seller can escalate the claim even of the buyer was the initial party that opened the dispute but did not escalate it. I had that happen to me, which then prevented me to make further comments as they needed more information from the seller. I only won the case against this other ebay seller when I had trading standards compile a letter which won me the case against him.
I would phone paypal and ask how they established that what he sold was a brand new mobile phone. The owness is always on the buyer to prove what he claims he has received. Get written evidence. You should never have removed the contact nos or messages as this would have proved how long the phone had been used for.0 -
If you have pictures on the phone you should be able to see when they were taken - ie a date and time before you bought the phone
