County Court Claim from Devere Parking Services

Hi

I would like some help please. I have received a court claim from Devere Parking Services as my car was photo'd in an incorrect free private parking bay. Total Amount £175 (£150 amount claimed and £25 fee).
I have read that only the owner of the car park can sue me and only for the amount that they have lost (? nothing as free car park).

What do I write in box 3. for my defence?

    First, have you confirmed with the court concerned that this is a genuine claim? Some PPCs are well-known for sending out fake papers.

    Second, if it is genuine, your best bet is to take this over to pepipoo and get advice on defence from the experts there.

    However, if it turns out not to be genuine, simply ignore Devere and any subsequent scam threats.

    I wondered when we'd hear from them. With 222, Devere just "pipped" Observices to the top of the list of PPCs who took the [STRIKE]36,000 to 90,000[/STRIKE] 845 victims to court in 2011. They also have a high success rate for cases heard in Bournemouth county court. I may have read somewhere that the owner was or is a magistrate. Allegedly.

    You dont write anything in the defence box yet

    You need to simply acknowledge the claim at the moment and ask for extra time to sort defence out

    Register on pepipoo and post on there, msg someone on Alexis on Pepipoo

    I hope your local County court is not Bournmouth
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    Start a new thread on there, dont give any identifying details out on the public forum side of things and be wary of new posters - generally the higher the post count the better.

    Search for and send a message to Alexis ( http://forums.pepipoo.com/index.php?showuser=15638 ) on there or AlexisV on here the two are the same, he's a dab hand at putting together a defence, I would say dont do anything till you have heard from him, just keep an eye on the time scales though, you dont want to miss the cut off time and get a default judement.

    Devere also watch these forums like a hawk so be careful what you say.

    Also agree with Muckybutt apart from acknowledging the claim first

    Can't a defendent ask for the case to be heard at a court of their choice, as long as it's not too far away?

    Absolutely. Cases are automatically allocated to the nearest county court to the defendant (where the defendant is a private individual as opposed to a company). However, experience suggests that cases are specifically selected by this company to keep the hearings within Bournemouth County Court's area. It is also worth noting that where sound defences have been filed the cases have been dropped.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
