sorry you are right i didnt answer your question. The landlord still has to follow the procedure serve the notice both s21 and s8 to be sure on the property, on the expiry if the executors have not been in touch he issues possession proceedings.

At the hearing he asks for a forthwith order rather than possession in 28/14 days as is normal, and then apply for a baliffs warrant of eviction and on the expiry of that change the locks just like any other possession.

The sooner he starts the sooner he gets his property back.

Thanks, I understand your points. I get the point that the tenancy does not end when a tenant dies and there may be others have an interest.

What I was really asking was what happens when when Billy no mates tenant dies. No family, no will, no executor. How can the LL serve notice?

It all seems a bit of a farce and just another example of how being a LL can be very hard work. Who factors scenarios like a tenant dying intestate into their business plan?

GDB2222 - why are you so prejudiced against Glaswegians? Please do not generalise.

So sorry! It was just a joke really at the expense of the other poster who was so belligerent. My ma went to uni in Glasgow, and she found it a particularly warm-hearted and welcoming city, and I actually love the place.
No reliance should be placed on the above! Absolutely none, do you hear?
