Cannot find warranty information in listing?

Item number: 200654644291

http://www.ebay.co.uk/itm/200654644291?ru=http%3A%2F%2Fwww.ebay.co.uk%2Fsch%2Fi.html%3F_sacat%3D0%26_nkw%3D200654644291%26_rdc%3D1

Parents purchased item, used twice. 2nd time of use, airbed went down in the night. Had to re-inflate many times. They could hear the air leaking out of the valve, even though it was set to off.

Have emailed seller for warranty, and seller said in short "Tough Luck - 3 months warranty on this item". We have checked the listing, and we cannot find warranty information.

We were thinking its the default 12 months, unless stated.?

Anyone?

Under SOGA the item would count as not fit for purpose and would be up to the seller to rectify. How you will force them to take responsibility is another matter though as you are out of Paypal claim times

I must admit even though they are a TRS personally reading their Negs and Neutrals I wouldn't have touched that seller.

I always thought things come with 12 months warranty these days, unless stated.

They don't. Can't understand why you would assume that!

But one could/should expect an item like this to last longer than 3 months, so under Sale of Goods Act you should be able to return for a replacement or repair. As the problem has arisen within 6 months, then the onus is on the seller to prove that the goods were of satisfactory quality, rather than the buyer to prove they were not.

  • Just to let you know that this is a common fault on these airbeds. We purchased one from Costco when we were having building works so sleeping downstairs. Had to return it after a week due to same issue, we returned 6 in total as they insisted each time we were just unlucky. We ended up getting a refund in the end but by then the bedroom was finished. We still laugh about rolling together and ending up on the floor in the middle of the night.

I then did a bit of research on the net and realised they seemed to all have the same common fault. Maybe you could contact the manufacturer? Worth a try?

    Hope this helps

There's nothing like that, the law is open to interpretation. The guarantee should be that the item is usable for a reasonable period with reasonable usage. Having dealt with mail order returns for some time I wouldn't buy any inflatable bed, there's always loads of returns in them.

As it was listed as new I don't think 12 months is an unreasonable expectation, contact Trading Standards if the seller won't help.

The maximum "warranty" you get with any item purchased on ebay is 45 days, the time limit you have to make any claim after that you are on rocky ground.
Some but very few sellers may honour a claim past this time if you are lucky.
It always makes me laugh when I see cheap laptop power supplies on there with a "36 month warranty" Needless to say I have never received a response when I have asked sellers if this warranty could be given in writing!
