seller can't refund as paypal is restricted

Hi I sent an item back for a refund as it was faulty and received a message today saying he has received the item but can't refund me as his paypal is restricted.
What should I do next, do I contact paypal ?

    He should still be able to refund through the original transaction even if the account is restricted. If he still says he cant I would open a dispute (via Paypal not ebay) enter your return tracking number so then Paypal can force the refund

    I can not open a dispute via paypal as it's been more than 45 days since I paid,
    what should I do now ?

    I purchased an android pad which stopped working after 2 months with a known fault to this pad, I contacted the seller who told me to return it for a refund and when I did he then told me about the paypal restriction.
    I have checked and found I payed by paypal using my credit card so it looks like I'll be phoning them.

    Assuming you bought from a business seller, then you would also have rights through Trading Standards and the small claims court.

    In general, known issues are usually fixed by the manufacturers or their agents for free. My Toshiba laptop had a fault with the DC jack. It was well out of warranty when the jack came loose but the local Toshiba centre fixed it for free.

    The next time something like this happens, sometimes it's easier to claim through the manufacturer rather than the seller. This sounds like a pretty dodgy person - so Consumer Direct might also be interested.
