Unrecorded phone call

Hi All

I have recently had a disagreement with my supplier over my energy bills. After protracted discussions with my wife they agreed to a settlement.

I called back to make the payment but they said they had never made such an offer.

I gave them the name of the supervisor, and the time of the call and asked them to check the recording. they called back later saying they had not recorded the call as the supervisor had used the wrong type of phone.

They reiterated that they had never made such an offer but they would be disciplining the supervisor for not recording the call.

Are there rules about recording calls to customers and if so could that become part of my complaint?

I cannot comment but I am glad that I have just purchased a Gigaset phone that can record calls. It should come in very useful when dealing with certain companies. Having a recording should provide some proof. How useful it is legally is another question, but it doesn't hurt having it just in case.
  • I once tried to buy a phone which recorded a conversation and found out it was illegal, against the data protection act, and anyone recording conversations have to have a licence to do it. suppliers will have the licence, they should also let you know that the conversation is recorded.

No. Private individuals do not require consent or to register with the proviso that calls made without notice are inadmissible in court.

If they have a licence tell you they record but can only quote the ones in their favor are they breaking the terms of the licence

Ofcom has a useful page here on the law regarding the recording of phone calls.

    http://www.ofcom.org.uk/static/archive/oftel/consumer/advice/faqs/prvfaq3.htm

In brief, Ofcom states that it is perfectly legal to record phone conversation for your own use, but that making the contents available to a third party without their consent is an offence.

Sorry but I think this has gone a bit off subject

I purchased a Gigaset N300A IP which provides VOIP and an answer machine. Also a S810H handset. It has a 500 number phone book and does SMS, weather, ebay, facebook, twitter and email checking, among other things, although I haven't yet got the email working because I have only had it a few days. Google mail can be difficult to get working because I have had difficultly when using gmail with Thunderbird. Pop3 access and SSL can be a problem. The security certificates for SSL could be the problem.

If you don't need the VIOP then you would need a handset with a base station which has an answer machine. There are package deals which provide that. Search google for Gigaset and answer machine. ;) Live recording is needed and not just message recording so make sure the phone does that.
This one does it and there are probably a lot more with different features. You can get them in different colours such as black or white. Tech gear is moving back to silver and white.

It was meant as way to prevent such situations from occurring in future. Even mentioning that you recorded the conversation might be enough to make them back down.

They know we didn't they called my wife at work and we asked for the recording, but thanks anyway.

Does anyone know if they are breaking the code by only recording some conversations?
