Assurant solutions - extended warranty problems

Two years ago I bought a Zoostorm netbook and took out an extended warranty with 'Assurant Solutions', which expires August 2012.

Earlier this year the netbook developed a fault, whereby it would not boot up. I contacted Assurant Solutions and they said it sounded like a software problem (Windows 7). It was returned to them and subsequently returned to me, in the same condition that I had sent it!!

I contacted Trading STandards/Consumer Advice and they advised that I issue a letter of 'Breach of Contract', I have done this and Assurant Solutions having spent 6 weeks investigating my complaint have denied liability, as their policy states that software is not covered!!

I may be thick, but from my computer experience, if the operating system does not work-then how is the netbook to work??

The netbook was bought without disks (as per norm), preloaded with software and there is a Windows 7 license sticker on the base of it!

The netbook does not have any optical drives, as advice from Zoostorm was to try and install an OEM 32bit version of Windows 7 via an externally powered cd/dvd drive-this did not work.

I now seem to be in a quandary as to how to proceed, as Trading STandard/Consumer Advice have left it 'to my own devices'.

I think I have only these options;-

1) Take a small claims court action against Assurant Solutions for Breach of Contract.

2) Buy a Windows 7 cd rom from Zoostorm for £60.00!!

3) Throw it in the bucket??

Does anyone have any alternatives, or advice they can give me please?

    Normally they come with a backup copy of windows on a memory stick or another partition of the hard disk.

    There are plenty of places where you can find copies of windows to download, as long as you use your key from the sticker on the bottom it will be legitimate.

    Personally I would try and fix it before going through the long and painful process of court

    There is a 'Restore to Original Settings', but that works for 39% and then stops!!

    I have tried to use a downloaded copy of Windows 7 & also XP (32 bit OEM), using an external powered cd/dvd drive-but to no avail!

    Thank you for the suggestion about the Memory stick, I will give that a go-you never know!!
