Capital One Reject PPI claim, when the "No" box was ticked

I hope someone can help and advised what options are available to me?
I received a letter from Capital One today saying that they have reviewed byPPI complaint and concluded that the policy was sold to me appropriately.
They have returned a copy of my agreement where it is clear that I haveticked the "NO" box, on 17th October 2003. However, they go onto saythat during a telephone conversation I changed my mind.
They go onto say...... We are confident that the optional nature of PPI wasmade clear to you when we discussed this with you during a telephone conversation6 days later after your application had been approved and you were in receiptof your credit card. The fact that your application was approved without PPI confirmsthat the policy was not compulsory.
Although I do have a pretty good memory, I can't remember any conversationtaking place. Also I can't understand why I would tick the "No" box onthe agreement and then change my mind 6 six later when my circumstance had notchanged and I receive full sick pay etc etc.
Capital One has stated that this is their final response and forward detailson how to further my complaint to the FOS.
Should I contact Capital One and ask them to forward a copy of the conversationwhere I requested PPI before contacting the FOS?? Or just further my complaintto the FOS saying that this conversation never took place and this is an error?
Any help would be appreciated.

Didn't someone else with a poor memory who didn't read their credit card statements for ten years post a similar story a few days ago?

I received a letter from cap one stating exactly the same. I think it is a standard letter so they can get out of not paying ppi back. I have been advised to send cap 1 a SAR letter. This requests all information and telephone calls they hold on your account and under the data protection act they have to provide this information. It costs £10 but they have to provide the evidence if they are saying ppi was accepted via a telephone call. I have no recollection of my telephone conversation with them nor did I receive any ppi insurance documents with a 30 day get out clause. I would send a SAR first to see if they come back with evidence of the so called telephone conversation then go to the Ombudsman. Hope this helps.0 -

Are you really surprised that Capital One reject your claim when you have had around 120 chances to query and cancel it.
I fully agree PPI was generally a complete waste of time but it was not always missold and most people could have easily cancelled it but did not.. I am amazed that banks are paying out so easily0 -

I'm with Chris J on this, I don't understand how people ignore the charges for years and then claim they didn't know about it. If missold then obviously am completely behind people reclaiming, but as someone who works in finance this is a massive hit for banks/credit card companies and in many cases PPI was a genuinely suitable product for the person in question (ie excluding where they wouldnt have been eligible etc).
Chances are you did agree to it on a call, they probably wont have the tapes but their agents are trained to upsell and it sounds like they succeeded.Officially Mrs B as of March 2013

I took out my credit card with Capital One when I was young and stupid. I didn't know any better , trusted that they were sincere and had no knowledge of taking out a PPi policy. did I read my statements? Yes; well, at least I read the bit at the bottom (the amount due) as I knew where I had used the card and just needed to know how much they wanted each month. No, I never went through them all in detail as the card wasn't used that often and my credit limit at the time was a mere £200.00.
Of course back then a policy could not have been 'mis-sold' this all came to light more recently. I never knew - genuinely - that I had a PPI policy. I wouldn't have taken it if I understood what it was, on a £200 credit limit! I don't remember asking for it, but have been told that I ticked an online box in the application, although Capital One have no evidence of this (I have today received a SAR that demonstrates this).
Don't be harsh on those that don't read the statements in full every month; if I was a savvy then as I am now I wouldn't even take a credit card out at all. However, I was categorically MIS-SOLD a policy no matter which way you look at it. What is my next step?0 -
You bought the card online, therefore no one sold anything to you, you bought it. It was not missold.
You complain if you want to using the usual route, either phone and complain, or fill in a form and complain.
The chances of actually being refunded are practically zero, and capital one have the lowest overturn rate at the fos smply because their sales were mostly online, or via a phone conversation, so don't hold out any hope.
If you genuinely idn't know you had one, you're going to have a hard time explaining how you can look at your staements, and not see an additional charge each month, no matter if you were young and naive. Unfortunatey, that's not a good complaint reason.Non me fac calcitrare tuum culi0 -
I wonder if we run a truth poll about miss sold, how many would say they just claimed missold just to get a refund.Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
