    If they have breached the contract, you can sue them through the small claims court MoneyClaim Online. It's inexpensive to do, and may help you get the attention of customer services.
  • What is my proof they have breached the contract, the paper I was given to believe or their take on things?

    In MY view of the world, they have had most of the last 2 1/2 months to fix this computer and they failed AND I have video/photos/documention to prove it.

    Is this enough to challenge them or are they just going to ignore it again???

    So you have all the evidence you need if you feel you have not received the service you paid for and have documented everything in a consistent and rational way.

    I have no idea if they are in the wrong, or you, just saying you let a judge decide - it's what they do, after all. Both sides think they are in the right, only one is correct, this can be remedied.

    TBH court proceedings are likely to mean you go to the kiss-and-make-up department who will say how unfortunate you have been and how wonderful they usually are and here's the problem sorted out plus a voucher plus a quick hug. Which is what you wanted in the first place, so job done.
  • I did not start this journey wanting a vouchers or a hug. :) I wanted my laptop, in working order, as it's a great machine when it works. But it's now 2 1/2 months later and they are telling me that they have yet another 28 days to properly repair it and nowhere in my documentation can I find that they have that right; as a Premier member, it says they have 10 days or replace it, and they've had it 3x now to do that.

    I have just written an email formally requesting a write-off based on their lack of service, the time it's taken and still no resolution, and their own words stating what I am 'entitled' to. I hate that word, but it is correct in this instance, as I am paying for a service I have as yet to enjoy.

    I have also requested that the issue be raised above the Let Us Know team's, as they are clearly unable to resolve this issue satisfactorily. If they can fix the laptop in the next month, good for them, but I want a working replacement and my hard drives (for security reasons).

    I have supplied them with documentation as to the behavior of the laptop except the last failure, which I have offered upon their request.

    We'll see what happens. I have been MORE than patient in this. THIS is exactly what I hoped to avoid when I purchased the extended warranty. HA!
