Santander Debt Sold on - Help Please

Hi everyone,

I have browsed these forums for a few years and have gained a lot of helpful advice along the way. I was in a pretty bad debt situation 5 years ago and entered in to a DMP with the CCCS (thanks to reading this forum).

I am now out of my DMP and making regular payments to my remaining credators, all at the required levels. However, when entering in to my DMP i defaulted on an unsecured loan with Santander.

Around 2 years ago Santander wrote to me and advised the debt was to be passed on to their DCA - Rockwell. Rockwell corresponded with me and I agreed a payment arrangement with them. I had no further contact from either Rockwell or Santander for 2 years apart from a yearly statement from Santander showing my payments hitting the account, even though I thought I was pyaying Rockwell.

Anyway, I received my yearly Santander Statement this week and at the bottom it said that the debt had been sold in May and that the buyer would be in contact with me. I have had no contact from the purchaser and Santander are refusing to help or provide me any information (as usual).

I have 2 questions - First of all does anyone have any advice on how I can proceed with my payments for this? I dont even know who has the debt!

Secondly, I am worried this new company are going to put undue pressure on me to make unaffordable payments and/or add fees to the balance. The loan is effectivly over, I am now just paying back arrears as the term has ended. Can they legally enforce the loan with me as usual, ie: go for a CCJ etc?

Also - the loan says it is settled with equifax back in 2009 - I dont know if that makes any difference, and the balance is in credit when in fact I know it's not because of my statement.

Any help/advice would be much appreciated. Thanks

    You might be better posting on the Debt-Free Wannabe board.

    First talk to CCCS to see what to do about interim payments.

    A collector/buyer can't do anything that Santander couldn't. CCJ is possible I suppose, but unlikely.

    Have you written to santander to ask who has bought the debt?
    Might be worth checking your credit file to see if the new DCA have entered an account and so find out who they are that way.

    Once you find them - just make payments that are affordale to you. If they put undue pressure on you to pay more than you can afford you can always refer to the OFT debt collection guidance in a complaint to the DCA.

    Yes its still possible they could get a CCJ - but as long as you make payments to them then its probably unlikely.

    It can take a few months for whoever bought the debt to get their life in order and contact you. They should tell you who they sold it to.
