Yes you can. In fact, the OFT ruling that is often cited about bank charges was in fact originally made about credit card charges. That's why many credit card lenders have now dropped penalty charges to £12.
I've succesfully claimed back from MBNA and Cooperative Bank credit cards so far!0 -
I am in the process of claiming back excessive credit charges which were levied against my account between July 01 to March 07. The total amount of the charges with interest is £478.42. Since the OFT recommendation, American Express now charges a default charge of £8. Since 2001 I have paid between £15 to £25 in default charges.
American Express has written back to me saying that they have informed the OFT that their default charges are £8.00 and reflect the costs involved in administering accounts in default and are calculated in accordence with the guidance issued by the OFT.
American Express have stated that they will NOT refund any previous default charges. I have calculated the difference between the original charges and the current charge of £8.00 to be a total of £229.00 that I have been overcharged in the last six years.
I would be grateful for any guidance on how to proceed. I am happy to accept the difference (£229), rather than the full amount of £478.42, but do not want to let this go. For Amex to amend their default charge from £25 to £8 is proof of their greed, and I feel that I am entitled to a refund of at least the difference between the original charges and the current charge of £8.
Has anyone else found themselves in this position ?0 -

Hi, just started but finding myself stuck with a few questions, can anyone help please:
1- Can you use the same interest calculator for credit cards charges.
2- Do you include your statements along or just the downloadable sheet stating the charges with the letter?
3-If you have several cards which belong to major Bank, do you file them individually, for example I have Tesco, Mint & Royal Bank of Scotland which all belong to Royal bank of Scotland, shall I send them together?
4- Each bank seems to have several address or departments, where can I find the right addresses?
5- In the case of current account charges should I send my letters to the local branch, or to the address which appears on my statement?

Hi,
I would like some advice based on the steps and templates provided by MSE for claiming back bank charges.
I followed Step 1, writing to Abbey requesting that the £152.76 (including interest) be refunded for charges made on the 12/01/06.
Abbey replied saying that they disagree and are not going to refund the amount because it was a long time ago and that I should have complained then. They went on to say that if we want to take the matter further we should follow their complaints procedure which is to write to their Customer Complaints department. If we are still unhappy with their decision, then to complain to the Financial Ombudsman.
The steps / templates suggest that if one gets the above response to threaten court action, i.e. Step 2 on the MSE page.
This is where my question to MSE lies. Should I follow Abbey’s complaints procedure, then if one does not get a favourable response from the financial ombudsman to then threaten court action, or should I go directly to threatening court action?
If I threaten court action, will they then not have a good argument that I did not follow their correct complaints procedure?
Thanks, and look forward to your comments / suggestions.
