vanquis ppi claim

last week i posted off 6 ppi claimback letters, where i ask for a copy of the t&c's which were in affect when the accounts were opened.
this morning i have received a reply from vanquis bank, but im now unsure of what to do next.
do i just send off a £10 cheque asking for a copy of the statements from opening the account, which was may 2007 to present as the account is still open?
any help or advise would be gratefully received...

    Here's my reply to your other post (in case you missed it)

    If you lack documentation of your own with regard this loan, you need to write a Subject Access Request (SAR) letter which should provide all information the lender holds on you for at least the last six years and (sometimes) more. It costs £10 and they have 40 days to respond.

  • well i got two more replies this morning, one from clydesdale bank.
    they have returned my cheque and letter saying all accounts have been repaid so have refused to send out any documentation!
    the other reply is from capital one and they have also refused to give us the information, they say 'as you may be aware the account went into default on 4/10/09 for £139.98. You have since made payments and we have recorfed a partially settled default onto your credit file'.
    the reason it wen into default was because the ppi we were paying for on the account wasnt actually worth the money we were paying for and didnt cover my husband losing his job! this ppi malarky seems alot more hassle than i originally though!

    No real point reporting to us that you've received more negative replies, you won't receive any T&Cs from closed accounts.


    Do be aware also that loans or credit cards which are in arrears or default are allowed to be offset with any redress which may be awarded. In other words, unless the successful complaint awards you with more than you owe you won't see any money personally.

    If you still want information from the Banks in order to advance your complaints, you need to follow the procedure at post 2 of this thread.
    At £10 a shot it could prove expensive for six different lenders.
  • thanks, i didnt realise if the account was closed it wont work. i was just under the impression when adverts say 'even if your account was settled and closed' that you could still claim! that was just how it was was!
    so am i right in thinking them the latest one i recieved that showed i was paying ppi for car finance when i signed i only wanted the car finance noting else, and i didnt tick the box that would sign me into paying ppi and i still ended up paying for it. does that now mean i cant get my £250 back even though they sent me a copy of all the t&c's and a statement and that account has been closed and settled since 2008!

    you don't need terms and conditions to make a claim, just account numbers and a reason for a mis-sell

    if you already have account numbers then there is no need for all this hassle with T&C just make your complaint with a valid reason

    But you have made no complaint yet, all you have done is request that the lenders send you the terms and conditions!

    As Burty said above, you don't need these T&Cs in order to complain, if you already have the account numbers and valid reasons!

    You can make a mis-selling complaint (with valid reasons) whether the loan or credit card is settled or not. It's the circumstances of your purchase that is most important in a mis-selling complaint,
  • well all i have done is follow the templates which are availible on this site. i havent got account numbers etc of the closed accounts, hence why i have wrote to the companies concerned so i can get hold of them. no wonder these companies are making so much money doing it on your behalf....wish id never bothered with this ppi rubbish, there are so many hoops to jump through i may as well be a hurdler in the london 2012 Olympics!
    as for the mis-selling, we believe that we have been mis-sold, take my car finance for example, didnt tick the box to say i wanted ppi on hire purchase, but was still paying for it for 24 months!
    credit card protection payments thing, was paying every month for that and when my husband lost his job and tried to use it, they declined and said unemployment wasnt a valid reason....then the account fell into arrears because of this....now it they arent mis-selling god knows what is!
