Ppi declined from capital one

in Credit cards
In 2002 I opened an account with capital one credit card aged 18. I did not ask for ppi insurance and my application states this. When I have tried to claim back the ppi their final response is that I took it out over the telephone when I activated my card and supposedly said yes to ppi. I was 18 at the time and this was 10 years ago. I have no recollection of the phone call nor at that age did I realise what ppi was and only realised that I had it was last year when I tried to cancel it. They have ignored my request and also a second request to cancel this in April this year. They are stating that it was on my statements and I should have queried this which I did but they ignored my requests. Should I now go to the ombudsman or request a SAR. My original application clearly states that i did not tick the box but they are saying i accepted this via the phone. This seems to be a common thing with capital one. I Would appreciate any help on this. Thanks

This is common with all cards where you activate over the phone. They have always tried to upsell insurance and card protection.
I have to say I have little sympathy with people who have sat for 10 years with these charges being added month after month but doing nothing.
You do however need to shout a bit louder about cancelling because it is just an insurance policy and a single cancellation letter should be sufficient.0 -
Thanks Chris J for yr reply. I was only 18 at the time and did not realise that I had ppi on my account. I have already sent two letters to them to delete this from my account and yet my requests has still been ignored by them.
I am going to request a SAR in which under the data protection act capital one should provide me with a copy of their supposed recording of the telephone conversation but I have heard that they make the usual excuses that they no longer have the tapes.0 -
10 years ago you want a recording from, you will be luckyDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

hi i put a claim in about May 2012 for Capital one. They rejected this after about 15 weeks saying that i agreed to the PPI on a telephone call. Like many people i dont remember the call as it was about 8 years ago. I was about 18 so also was a bit clueless about things. I also didnt check my statements so i can honestly say i didnt realise i had it on - i should pay more attention. I asked for a copy of the call but they could not provide me with it. Which i think is pretty bad as how can they prove what was discussed?
Anyway i referred this onto FOS and i received a call Friday to say that they are upholding the complaint and in favor of me. Which is fantastic.
They have given Cap one till 28.12.12 to say if they agree or not and if not they have to give more evidence of why not and give more documents that have not been provided previously.
Has anyone else had this?
Hopefully it will go through OK.0 -
iv just had a reply from the Fos to say capital one dont agree with them upholding my claim and think they did make things clear in the call when i took out PPI.
They have asked this to be referred onto an ombudsman for a final decision. So bet this will now be rejected!0 -
