Carers allowance

A question on behalf of a friend here..

He is in receipt of Carers allowance and the person he looks after is in receipt of Attendance allowance.The person he looks after is in hospital at the moment,its possible that the person he looks after is going to be going to a home after being assesed as best for her needs.

She has been in hospital for a couple of weeks so far...

Question is what happens after 4 weeks which i believe is how long a person can be in a hospital without any effect on either attendance or carers allowance?Does this mean that an 8 week period comes into effect or does it cease immediately after 4 weeks?(i believe if the person dies for example - carers allowance continues for up to 8 weeks)

    CA is payable for 12 weeks after the DLA ceases, DLA payments stop after the they have been in hospital for four weeks.

    If someone receives Carer's Allowance because they are caring for you, this can continue for up to 12 weeks if either:
    you go into hospital
    your carer goes into hospital

    Carer's Allowance will stop if your Disability Living Allowance or Attendance Allowance stops. This is normally after you have been in hospital for four weeks.


    Can you explain why my hubbies was stopped after four weeks?

    The 12 weeks applies to a carer of a child, as a child can stay in 12 weeks before DLA stops.

    I've done some more checking. As absurb as it sounds we're both right, but you are more right than I am, so my apologies.

    60046 says that you can remain entitled to CA for upto 12 weeks if you or the person you care for go into hospital.

    60050 says that if payment of the enabling benefit stops then CA stops as well, the exception being where the caree dies.

    So although CA should be payable for 12 weeks, because the DLA stops after 4 weeks in hospital so would the CA.

    No worries. When we had to look into it, and enquired why they state "up to 12 weeks" they said it was because a carer of a child can receive it for 12 weeks as children on DLA can stay up to 12 weeks before benefit stops.

    In either case as soon as DLA ceases, so does the carers so it's not really worded well on the link I posted.

    Not sure if the new rule is applicable yet where they also take back motability cars after four weeks (never used to) but that is going to create a phenominal amount of cost.

    The cars are different. It's only DLA Care that stops when in hospital not the Mobility component.

    At the moment yes, but that is changing. They are bringing in legislation to be taking cars back and stopping motability payments. I *think* it is with the introduction of PIP, but will see what I can find as it's a while since I read it.

    Under the current plans, Motability Scheme customers would stop receiving the higher rate mobility component of PIP if they spend more than 28 days (4 weeks) in hospital. This means that they could lose their Motability car, causing stress and a loss of independence. We think that this plan needs to be reconsidered.

    - the issue under PIP as its currently proposed as I REM it is 28 days and PIP is removed - so car is removed
    - then there is the linking of 2 stays with less than 28 days between which leads to the same thing
    - then when you are discharged and PIP is reinstated the task of a~n~other Motability vehicle application process
    - will mean that Motability recipients in work / hospital visits / and general shopping & living etc mobility will suffer

    I might add the above is as yet not firm in the legislation, for example we don't yet even know how long it will take for PIP to be reinstated let alone how long it will take to reapply and have a Motability vehicle reinstated. I do agree with Anubis that there are many many freaky but devastating side effects to peoples lives that can be impacted by the introduction of PIP and UC that may not have been considered in the impact assessment. Indeed it is the case that the Impact Assessment released just 2 short months ago makes no mention of hospital or Motability.

    The March this year 'DLA reform and Personal Independence Payment – completing the detailed design' states the following is still in 'consultation' :

    Payability of the benefit for certain groups – how payment of the benefit will be affected for residents of care homes, hospital in-patients, and for people undergoing legal detention; and not providing for an extension of the mobility component to Motability leaseholders affected by the hospital rules;
