Item not arrived. Have proof of postage. Can I get a refund?

A little bit of advice please.

I purchased an item on 27th june and it was posted 2nd class on 29th June. The item has not arrived. I have contacted the seller and they have provided me with proof of postage.

Am I entitled to any sort of refund? I am a bit reluctant to open a case as the seller hadnt done anything wrong.

    Yes you are entitled to a full refund from seller, the certificate of posting is for the seller to use, not you.

    However, getting that refund depends on how you paid. Hopefully this is an ebay item and you paid via paypal, if so ask the seller outright for a refund, if they ignore you or refuse open an INR claim in paypal and you will win and get all your money back.

    EDIT: Don't worry about the seller, as a seller myself we know we remain responsible for our items until the buyer gets them- and thats why we obtain a COP.

    The contract to deliver is one between the sender and the carrier.The sender needs to initiate a claim.

    As per the other two. Send the COP back to the seller and explain that they should refund you and claim from Royal Mail themselves.

    Personally if anyone sent me a COP through the post in response to an INR, I'd just open an INR case with ebay or paypal. And if the seller asked for the COP back, I'd ask for p&p to be covered first.

    And here. Luckily I've usually had no problems. The only disputes I've been to have been resolved without sellers trying to force the COP on me.

    File an item not received dispute, Ignore any requests from them. You want a full refund.

    Just say the post office said you couldnt claim because you didnt post/pay for it. The sender has to claim. And as above ask for postage costs to return the COP.

    Let them do the work not you.
