Help to get my children what they are entitled to without my benefits being affected.

    OP I think you've got a cheek coming on here asking for advice on ways to cheat the system (or in other words the taxpayer). You are hoping to get £6k in your name and put the rest in your kids name so that you can still have our money instead of standing on your own two feet for a while, what a joke.

    I also struggle with the fact that OP wants to give her children a secure finanial support yet doesn't claim the vast maintenance they are entitled to (way more than the small amount of equity she is allocating).

    Surely if she saved the maintenance (for previous and future years) it would be way above and beyond that small amount.

    Given figure above of £1500 pw - you are looking at £600 pm per child Minimumm (no arrears noted).

    I'm not sure how CSA works - but would they consider his capital as back payment? If so OP would get a lot more that would not affect benefits at all

    Op you are entitled to that money, take it declare dont let him have it will close your claim to ESA
    Pay off all your debts, give the children 3k each live on the money till it goes, the 6k to the children would be safe as you are allowed 6k, apply again.
    Keep all your receipts for the debts....
    Why should you do him any favours.....

    If you had the concentration level of an adult and not a child you would... well might have understood my situation.
    I have always stood on my own 2 feet, I worked hard and took care of my family and my home which I was buying, I have always payed my taxes and NI (which I still pay)
    My marraige broke down because my husband was and is scum, I moved home with my 2 children as I had no choice because I will NOT be treat like a mug!, I rented a house, bought new furniture with my wages that I earned standing on my own 2 feet as my scum bag ex wouldnt even give me my childrens beds, I made a new home, Supported my children and worked and payed rent a mortgage and council tax with money I earned whilst standing on my own 2 feet and the only reason I can no longer work and have to rely on benefits is because I faint at least twice a day, I fall asleep with no warning and somtimes I wake up 48 hours later not even realising ive been asleep and I am on the strongest heart tablet that is on offer to try and make my heart beat at the speed it should because it almost stops, and my blood pressure is really low which affects my sight concentration and speach, I got diagnosed off a top proffesor in a top hospital and as my condition is rare no one knows how long i will be like this, if I'll get better or get worse, So I would much rather be working than going through what I go through every day and then If I was able to work and I was not ill I would not have to worry about my childrens future... Its people like you that make me sick, Im 35 years old and I bet you couldnt handle 1 day of my life.. So you go to work and earn money for people like me who have got a nerve asking for help... PS do some over time!!:mad:

    It is not an easy situation, Im ill most days, my ex and I can't communicate, He resents every penny I get and when I have got the energy to confront him he tries to kick my door down and ive phoned the police loads of times, He mentally tortures my girls, I will get threats from his family when the police get involved, and this has been going on for 5 years... if he had it his way I would get nothing, I have come along way to get what i actually get now the only way this would be easier would be to move away but I need to family to help me every day. I suppose you would have to see what this man is like to fully understand the whole situation how much my girls and I have been though to get this far.

    I am fairly certain that for means tested benefits, children's savings are counted as the parent's savings. Please check this out because if I am right, you are going to complicate the situation yet make no difference to the outcome. Even if I am wrong - the fact that you are entitled to this money but arrange for some of the money to go to your children for the purpose of keeping your savings within the limits for claiming benefits will almost certainly be viewed as deprivation of capital, in which case you will be assessed as if you actually had the money.

    You need to seek advice. Solicitors are not always the best people to advise as many are not up to date with welfare benefits rules. You might be better to contact the citizens advice bureau, and ask for a welfare benefits adviser.
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

    Why don't you try doing some work instead of telling others to do over time? I'm also a fainter, landed on the transplant list because I got so weak and it was hard but it isn't impossible.

    What you're asking is tantamount to asking others how to commit fraud, it's that simple. If you dont take money that you're entitled to then a DWP decision maker can decide to treat you like you took it anyway. If you give your children 4.5k each this too is deprivation.

    So you paid tax and NI, well done. Benefits are for people who have nothing else, not for people who have 20k sitting waiting to be taken but are loathe to spend it on rent.

    Ill or not, it still doesn't give you the right to cheat the system and take of taxpayers.

    BTW how do you look after your children if you fall asleep and wake up 48 hours later? Surely they would be better off with their father.

    Your children's education will cost the state over £5k a year, so that will be in excess of £100,000.

    Your medical treatment (off a top professor at a top hospital) will costs tens of thousands.

    You receive benefits of around £20,000 per year.

    As you are 35, you have probably paid in tax for around 17 years, during which time you received some of the services paid for by that tax. Now you are not paying tax (I don't understand why you claim to still be paying NI). You are unlikely to have paid enough tax to come close to matching what you will get back during the periods you are not paying tax.

    Meanwhile some people have low incomes and pay tax but receive no benefits or assistance. They are not able to put £4k or more away for their kids.

    Why should you be supported by such people whilst you have diverted savings to your kids? :cool:

    Surely your ex is being rather silly, why is he having his income earned in Africa put into a UK bank account?

    My brother in law works abroad - currently in Lagos for 6 months, then off to Indonesia for another 9 months. At most he would not be in the UK for more than a month a year. He comes home for a week, followed by periods of days then flies off again.

    He says that he is fed up with the British systems of taxation and child support.

    He does not have any of his money put in a UK bank. Only his unspent expenses are transferred over to England.

    Earning £1500/£2000 a week is not uncommon when working abroad.

    We speak via Skype every other week and it was only a few weeks ago that he said that he could never work in the UK again, as the rate for the same work is nothing short of disgusting - £10 an hour!!!
