To Claim, or Not to Claim?

I was recently hit by a car and was wondering if I could get some advice on making a personal injury claim.

I was on a pedestrian crossing with my husband, when a car drove through a red light. The car drove over my foot and I removed the wing mirror with my stomach, and cracked my elbow on the car.
Following a trip to the hospital, I was released with no broken bones (thankfully) but with instructions to stay off my foot. I also got a pair of crutches to go home with.

While in the A&E dept. one of the police officers who attended the scene arrived to advise that due to being no independent witnesses (driver stated her light was green, I stated my light was green) and no CCTV evidence, the police were taking no action, other than giving the driver a warning.

Basically I'd like advice on:
1) Should I make a personal injury claim?
2) How do I make a personal injury claim?

    If there is definitely no evidence it may be difficult. But in this position, I would probably make enquiries with a no win no fee solicitors to see if they could help or not.

    The fact is you were on a pedestrian crossing, so the driver of the car should have been taking care for pedestrians likely to cross the road, by slowing down, to anticipate people using the crossing.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    You might want to check on your home insurance policy to see if you have legal cover.

    This would cover you up to a certain amount for legal advice and fees (usually £50k) and if you do use it, it does not normally impact your no claims discount for the following year.

    They will however usually only take on cases with a reasonable chance of success but at least should be able to give you some advice.

    If you don't have legal cover you might still have access to free legal advice via your home policy (check the policy book).

    Otherwise there are many firms who specialise in personal injury claims but I don't have any personal experience of this to be able to recommend one.

    1) Assuming you have the third party details, Yes!

    2) Google for cashback injury solicitors who will pay you a commission just for instructing them (on top of all the compensation they win you) on a no win no fee basis.
