Tenants leave with no notice - several items missing from house

    You were evicting them. Why are you upset about that?

    Did you put the equivalent of their deposit into a deposit protection service when you found out the LA had ran off with it?

    Yes, they have a deposit saved (at my cost obv grr)

    And, these are different tenants actually not the ones issued sec 21!

    These tenants have been in the house 3 years and never been a problem so no way i was going to evict them!

    Good point! You cant make any deductions if you dont have that...

    Also, are these the same tenants that wouldnt leave and you were asking for eviction advice? Surely you should be pleased theyve gone even without notice ;)

    If it was those tenants id be on the champers by now! lol

    Okay then, so is it going to cost more than the deposit to get the property back to how it was at the beginning of the tenancy, without betterment (ie you cant charge them for a new table, only a 3 (+?) yr old table.)

    Yes and no - it would replace the beds and table / chairs.
    However one room needs a new carpet - it has oil literally dripped accross it, and boot marks in oil.
    Another needs some re plastering.
    And i randomly have 5 broken window latches.

    Where do i stand also on the no notice, and no rent for this month?

    Its all a huge hassle - i cant wait to get out of being a landlord as such!
    (My dad died in February, so i had no option but to take it over)

    You cannot simply charge them the replacement cost if they are 3 yr old items (how old are they actually, do you have records of when your father purchased them)

    Second hand beds and tables are not expensive.

    Same for the carpet, how old is it? How long has it been since the house was decorated?

    If you don't want hassle I would send them detailed photos and a list of your 'gripes' saying right guys you've took x and x and x plus oil on carpet plus no rent for last month so I am keeping your deposit, and see what they say. The way the text is worded it sounds like they are half expecting that anyway.

    Do you really want to pursue through the courts?

    Surely if you are wanting to 'get out' of being as LL you will be selling the property. If you are selling you don't need to sell with a dining table and bed.

    It was all new - bought for them to move in.
    So now 3yrs old, but it was of decent quality - not Argos jobbies!
    Carpet was also new on moving in.

    To be fair, i just want to cover myself, as it really wouldnt surprise me if they asked for the deposit back!

    The house will be up for sale.
    I think im just shocked at the audacity to just take the items to be honest! I really expected to just walk in and find the place 'kiddified' not missing half its contents!

    Wait until the keys have been received in the post, then arrange for dated photographs to be taken of everything.

    Then, get onto the deposit scheme and claim the whole of your ex-tenant's deposit.

    You then have to decide whether it's going to be worth your while trying to trace them. Expect absolutely no help from the council as they will not disclose any information to you. But it might prove helpful to the council, if they are still claiming benefits, for them to be aware that they have left your property without notice, damaged and with furniture missing.

    If you can wait a while people usually turn up eventually, often when they believe everything has blown over. Electoral register. Phone directories/192 etcetera etcetera.

    I might even be thinking about having a chat with the police about theft....

    Be prepared for a load of hassle about unpaid utility bills and them not informing CTax about having moved out.

    I would definitely be having a chat with the police about theft.

    It's not a civil dispute, that is a criminal matter and cases have been reported on at court where the tenants were convicted.

    Landlords make plenty of money out of renters but there is always a risk that things will go wrong. It's comes with the territory and perhaps you should just write it off against tax and just be grateful that you had 2 years 11 months of rental income.
