Motability - loss of HRM & Appeals

Info only:

- it used to be in a case of lost HRM and a subsequent appeal that discretion was available from Motability
- frequently, in fact almost invariably they would allow the keeper to retain the vehicle for the length of the appeal
- in Sept last year this discretion on a 'case by case' basis was officially removed and the car had to be returned

My point ? - there are three, that because of the (1) appeal hearings backlog (2) that discretion was officially removed from their procedures and (3) it had a specific 'date-line' of September 2011.

    my sil has been on various worsening rates of dla for 12 years back spinal operations etc

    she had to reapply for dla short time ago in june and had her award highered to hrc hrm then got called to an IB atos medical now has had IB benefit stopped and also all DLA what should she do what can she do and how quickly will her car have to go back she is going to appeal but is a IB appeal, if she can do it different to a dla appeal

    she rang me yesterday in tears as it is her only lifeline i am going round shortly to look at the paperwork but would like to go round with some helpful advice

    It has helped us understand more about ESA and DLA.

    Information from filling out forms to apply and also appealing the decision if needed.

    Welcome to the forum essexmad, I'm not sure if encouraging other Money Saving Experts to visit a paid for site costing £19.45 per year is a good thing - but welcome to MSE anyway :D

    how do them sods sleep at night. i pity there mothers, how do u go from hrc,htm to nothing have you had the hand of god touch you on the shoulder by a artos doctor by chance. they need to be sued. they are top class idiots.:mad:

    My husband's DLA was up for review in June this year and after 13 years with no improvement in his condition we expected him to be re-awarded high rate care and high rate mobility. Sadly as is the case for many his award was withdrawn altogether with nothing being offered at all which is truly unbelievable anyway he has lodged an appeal and received a standard letter from DWP stating that his appeal has been lodged but mean while perhaps another decision maker may overturn the new decision but it can take up to 11 weeks to decide and only then will it progress to appeal stage. His car was taken back last week with no solution being offered that would let him keep it. I suspect next they will go after him for his Incapacity benefit.
