Still not got my refund off welcomeloansuk even after doing all they asked,i waited the 14 days then sent a notice of action (found a template) to there legal compliance officer and its gone ignored.
I sent all requests signed for delivery and have proof of delivery.

Not very legal savvy so a bit unsure if im in a position to go to small claim courts to get this back?
Or is there some sort of time limit before i can take the court route?
Any help will be much appreciated.

    Did you send the letter by recorded post?

    If not send again. Like debt companies they will ignore anything they don't want to hear about if its not recorded.

    yes i sent my initial request and the notice of action via recorded delivery and have signature/time date for both

    You're doing everything right so far, nobody said it would be easy!!
    You need to raise a Formal Complaint now, use the previous correspondence as enclosures when you write.
    Make sure you state clearly it is a formal complaint for a full refund of the money.

    Sadly you have to give them 8 weeks to respond. They will continue faffing, denying, stalling in the hope you will get bored and leave them with your money.
    Ensure the letter is dated and count forward 8 weeks. State this date as the date you will raise your complaint with the FOS if you don't receive your desired outcome.

    It's a breath of fresh air to see someone doing things right. Please keep this updated so we can link it when more people fall for it.

    You can go stright to small claims, FOS etc now if you wish, but they will always expect that you have followed the laid down procedure first to give the company a chance to defend their "honour!!"

    Thankyou apples once again for your advice.
    Just finished printing off the email conversations/proofs of delivery and copies of both letters ive sent.
    Were going to have to go straight to the courts as we really cant afford to be £70 down were currently receiving benefits and thats a large sum for us to go without.
    Once this is sorted anything i have of use templates/advice etc will be open to all the lovely helpful people here should they need it.
