Very Interested in a house but.... owner doesnt want to sell

Ive been looking to buy a house for a year now and havent seen any that i was keen on but i've encountered a great house in herts area which seems ideal but the owner has said she's in the middle of a divorce and doesnt want to sell and shes trying to buy it herself?
I dont understand? why the for sale sign and advert with the estate agent?
Im confused?

    Why not go have a chat with the estate agent for the full story.

    It may be she's still coming to terms that the house will HAVE to be sold or she may still be investigating if she CAN afford to buy her ex out.....or you may be about to step into the crossfire of a warring couple -Best to find out first and then see if it's worth waiting a couple of weeks to see if things have changed or not (If it's the third tho-Run like heck !!)

    Or if you made a low offer maybe it was a polite way of telling you to take a hike ;)

    "The owner is in the middle of a divorce". Trying to buy a property from a couple splitting up is the quickest route to tearing your own hair out that I can think of. It's likely that one person is keen to sell up and cut all ties while the one you spoke to isn't so keen and might be trying every kind of delaying tactic they can think of. Or maybe she's being honest and would rather raise a mortgage on her own but they will be using outside offers as the actual value of the property fro mortgage purposes.

    Don't expect to be able to buy this property any time soon.

    Because its a divorce and the other party probably wants to sell and split proceeds. So putting on the market gives a good indication of value and interest at that level; albeit the resident wants to then buy it out from the other partner..

    Quite common actually..
  • She's probably in the position of having to sell for financial reasons. We bought our house after leaving an ultimatum through the vendor's estate agents when we were messed about. The vendor left us a lovely letter on completion telling us exactly what she thought of us. Walk away. If there are any money issues the property may have been neglected or bodged, which happened to us too. Move on, there's plenty of houses out there, and be patient, the right one will come along.

    probably best for me to steer clear.
    it's just it's the first house that ticks all the boxes, its been on the market 6 months already, i think shes been putting everyone off as its reasonably priced.
    just confused to whether the house is for sale or not and whether she can afford to buy her husband out and if she cant is she in control of the house sale or are solicitors behind it.
    I dont understand why it's on the market if its not for sale

    One party wants to sell and the other does not. For the moment.

    Keep an eye on this property by all means but only actively pursue this one if you are prepared to have your time wasted.

    Quick question Divorce related...

    If couple break up put house on market, then one of the two kill themselves. Will the house still have to be sold or will the other person be left everything as still next of kin?

    Wouldn't this depend on the type of ownership and wills?

    Next of kin has no bearing. It entirely depends on how the property is owned: either as joint-tenants where the remaining party automatically inherits the dead person's half or tenants-in-common where they do not, and is subject to who inherits according the will
