Threatened at work now scared to return- Right and Law

Hi
Im asking on behalf of a friend who has been a hard worker for a company, covering holidays and also manager mistakes on the rota. Then a very nasty trainee was employed and very threatening to my friend to the point where she needed to get cabs home and seek assistance and advice off the manager too which she got the reply "deal with it,get back to work" it got so bad she could not return and applied to the area manager for constructive dismissal. They have since rung and said that the said person has been fired and for her to return to work, she still doesnt feel safe as no meeting has happened between management and herself as she feels the manager at the current job fobbed her off when she tried to report and explain the problem with the current situation. Is there anything like severence or any form of way she can still request the management with seniors to explain the fears she has with being ignored by management.
Thank you

If the person has been fired why would she not want to return? Can't the other issues can been sorted out once she is working?0
-
If the reason for leaving was a threat that has now been removed she has no reason not to return.
She can raise a grievance once back at work for the initial poor handling of the issue by the manager but I don't see a payout in it for her.I Would Rather Climb A Mountain Than Crawl Into A Hole

How do you apply to your employer for 'constructive dismissal'??
Has she actually handed her notice in???"You were only supposed to blow the bl**dy doors off!!"0 -
I've no idea what the constructive dismissal comment is about.
OP, your friend should go back to work and request the meeting. The 'threat' has now gone, so it's not there. Your friend might still be upset about it, but refusing to go back to work even though they have acted appropriately isn't helpful. She needs to do something positive and proactive.
Has she resigned? Or did she just not turn up to work?

Chances are that if she doesn't go back to work, she'll be the next one to get fired!0

No she had left on friday after the threats got so bad she had to take a cab for her own safety as was a male employee, yeah she is desperate to return to work but worried that the issue of management not taking it seriously till she had requested head office to step in will cause them to make things even more difficult for her. She is lost not being at work, she didnt not show she just had told her manager as she left she cannot work in these conditions with the stress and looking over her shoulder that she would have liked to sit down with her area manager to make sure she was fully safe and all issues address'd...like the manager whom didnt take her complaint seriously only did this she feels because she went to complain to the area office. She had went down that route with her complaint to the area manager as all the HR procedures she had exhausted so she asked for her annual leave to be activated till the issue was resolved.
She just is worried that she will go back and it will be different and the manager and staff may be unduely off with her.
She is very eager to get back to work and she was really at the end with choices and didnt come to this lightly she just wanted to ensure she and her family were safe from this man.

Thank you
No because her fears have been addressed and the cause has been sacked.
She needs to grow the hell up and get back to work or hand in her notice and let someone who wants a job take hers.0 -
why did she not call the police?0

thank you for your replys
So it's not a safety reason she won't go back. She's just upset.
I say this kindly, I really do, but she can't just not go back in case people are mean to her. How does she ever cope in an adult world if she's worried that people will be 'off'?
They may be off with her, they may be frustrated with the situation. But they've taken action now, so she needs to do the right thing and get back to work.
If there is still a safety issue with her and her family from this man, then she should call the police and have it registered that she has concerns and fears (for whatever he said or did). But that's not a reason to not go back to work.
Her only other option is to resign, but it doesn't sound like that would resolve the problem of worrying about her family, so getting back to work is probably the best thing she can do.

(snipped to only have the parts I think are relevant.)
OP, she can't stay home and say "I'm too stressed just in case my management won't like me now!" If she gets back to work and finds that is indicated to be the case then she can raise this but she can't claim it before she even gives them a chance!0
