letting agent not giving back deposit back!!!

Hi Everyone
from what i have read this seems a common problem left our rented house on 16th feb and wrote to letting agents they had served us with eviction notice for this june as owner wants to sell house It was agrred by all that if we found some were else to live the sooner we could move out the better So we did everyone was kept informed The letting agent then went to the house to do a check out on the 26th and sent up a very rude 4 page letter saying we had left the property with loads of faults eg we had not cleaned out spiders webs in outside plant pots!!Anyway we got the owner of the house to visit the property on the 3/3 and she phoned us to say she was more than happy with the way we left the house So far we have sent 3 letters asking for our depost back (£1200) and the last one we even sent with a letter from the owner confirming she was happy for us to have our money back They dont even reply and when i call they say the manager is always busy??What can we do its alot of money to us and we really cant do without it!!!??? Any help or advice would be very welcome

Would the letting agent give the money back to the owner and then the owner could pass it onto you?
Perhaps write a letter saying that if you dont have the deposit back within x amount of days or by date x that you will start legal procedures such as the small claims court?

but what did the agent say excactly, I'm sure they never sent a letter saying they are keeping your deposit for not cleaning the spiders web out of plant pots.0 -
hi no they wont give the money to the owner either haveing talked to her the previous tenants did over 4k of damage the letting agents kept there deposit quite rightly but the owner of the house didnt get any of the damage fixed she payed for it To be honest her husband was dying when we moved in and i dont think she had time to get another agent
We have threatend court action in this 3rd letter but again no reply whatsoever it will cost us another £120 to take them to court and we have been told it can take 8 months!!
I would just love to find away of getting people like this in the press and show people what they are like!!!!!!!0 -
to awnser your question ianian thats the problem they just wont talk to us at all Just the 1 letter about the state of the house no replies at all! to the ones we send0

Are you sending all documentation recorded delivery and keeping a copy yourself?
I think I would send one last letter stating you are beginning legal proceedings then start them - I would inform the owner thats what you are going to do thoughWeight Loss - 102lb0 -
yep all sent recorded del have print outs of royal mail del to them Just not what we need at the momment we cant even by wardrobes for our kids clothes !!!
I will have to let the owner know i hate to bother her such a nice lady0
