Help ebay refund where do I go from here?

I have been a regular user of the forum for a while but this is my first post so hello all. I hope some of you can help me.

Summary of my situation:
Bought phone of ebay around £75 and £5 p&p through paypal on credit card on the 29th January
Found fault with phone and return it to sender for refund as agreed with them, as I did not want payapl to charge me £12 fee for going through the dispute console.

4th March told that they are uploading money to paypal account and it will be there on 6th. Heard nothing, contacted seller and heard nothing, can see they have been buying and selling on ebay since.

18th sent message to seller on ebay requesting a response otherwise I will contact ebay by wednesday. Have also requested there contact details which turn out to be different to those which i was sent the phone from and returned the phone to.

Also seller has good feedback.

Where do I go from here? Is there anyway to avoid £12 paypal fee and where do I stand as I recieved the goods and sent them back it is not as simple as not receiving them?

I have the postage slip from when I sent them back, but it was sent to wrong house but have email from seller saying she now has got it... :(

    When the seller sent you the phone was it sent via Special Delivery?

    Paypal rarely charge a fee for disputes and their help files are extremely confusing. I wouldn't rule a dispute out as a last resort.

    That's a strange kind of complication... but as long as you can show that it has been signed for, you'll hopefully be ok.

    I'd say proceed by speaking to the seller as suggested above.

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    I requested the sellers details and these are incorrect as they are in leicester and the address we have been using is in kettering northants. I phoned and was told that i'd got the wrong number when I rang as the different addresses would indicate.

    Also does anyone know how long I can afford to leave it before filing a dispute?

    They need to be reported for incorrect contact details.

    I guess your next step would be to start a dispute via PayPal. If that fails then I'd suggest you contact your credit card issuer and claim that way.

    Paypal rarely charge a fee for disputes and their help files are extremely confusing.

    From a Paypal dispute email received yesterday:

    "Our investigation will be made on a best-effort basis and PayPal cannot
    guarantee recovery of the funds. For transactions that do not qualify for
    PayPal Buyer Protection, eBay will provide Standard Purchase Protection for
    $200.00 USD coverage with a $25.00 USD processing fee. For more information
    about our Buyer Protection Policy, please review the PayPal User Agreement
    at:"
