This is a different topic so please please don't have a go at me. I change lock as advised by here and my solicitor. Landlord cme yesterday and said I !!!!ing am coming in you !!!!ing !!!!!. Laughed a bit. I called police but as he left before they came I called them to explain and cancelled police request.

Today landlord came with another woman. Front door open cos kids playing but inside porch one shut. I was on phone. Ll came in whilst I on phone breaking the inside front door. I had kids dad here fortunately who managed to get guy out with a fight and I struggled with woman who'd pushed me and my 2 year old son scratched my face and pulled my hair. I was on phone at time so had it ti hand and I called 999 immediately. 3 Police officers came and were unbelievably unhelpful. They Said that if I pressed charges that they'd arrest us all. Male pc said ll had said agent said I not paid rent for 3 mths. I told officer there and then I could prove as I'm paying by standing order and therefore have proof. I told them if he had communication probs with agent then that his issue. He lying anyway cos would have issued me with s8. Police said ll had a right to come in cos his property. What the !!!!. When ll used his usual 'im coming to do inspection' and that he'd given notice to me i produced the letter thf agent had delivered in the morning by hand. Ll claimed ignorance which is hard to believe because it was for firsr thing monday. Initially police said coming with him on Monday to keep breach of peace to allow indpection. But then said between solicitors and denied him right to come on Monday. I called to make complaint about all incidents where police been. Operator was lovely and cited the criminal law act 1971. And made a record that he advised me to put bolt on door. Said officers inexperienced. Then sergeant called in response to my 'conplaint' and said ll can come in whenever and that of If I bolted of changed locks door then criminal damage. My solicitor appt Monday. Emergency council only deal with homelessness. The Sargeant let me know he was a landlord too. just my luck.
Am so scared. I keep trembling and am in tears. Two kids at mums. People think ll wont come back but am scared. What if kids dad not here. Just feel so numb and hopeless. Just don't know what to do.

  • Having read the other threads, i don't think there's anything to add. You've been informed on what your legal position is. If the landlord and police ignore the law all you can do is take them to court or involve a tenancy relations officer if the council have one.

    You have a solicitor, make them earn their money.

    I thought once locks changed that would be it. Till court. Landlord breaks into property and assaults you. Police do nothing. My solicitor appt on Monday. I know I'm rambling but is there anyone else I could go to as a matter of urgency. Monday seems an eternity off. Just scared bout them coming back.

    Its quite possible under the circumstances that OP is in fear, upset and in shock. Under such extremities it is quite reasonable to assume the OP is not going to be very coherent.

    OP, if the Police failed in their duty I would issue a complaint, but your priority right now would be under the circumstances to apply for an injunction against the landlord—this is a court order preventing someone from doing something, in this case, preventing your landlord from harassing you.

    If you have a solicitor, you should inform them of the situation.

    OP - the behaviour of the LL and the attending police officers, as reported here by you, is appalling

    Shelters Helpline opens again tomorrow at 8 am
    see http://england.shelter.org.uk/get_advice/how_we_can_help/housing_advice_helpline. They will always be busy but do persist so that you can get some proper support with this prior to Mondays appt

    You may want to remove that incident number ( or part thereof) from your earlier post btw.

    Keep the exterior doors bolted when you are at the property.

    Do you have a friend or relative who could come and stay with you temporarily?

    If you have been assaulted by the LL, or someone acting on his behalf, then photograph any injuries and make a formal crime report

    Your solicitor should be able to help you sort out both the LL and these errant police officers, who are clearly totally ignorant of the law on how and when a LL may access a tenanted property.
  • One thing you could do is make a homeless application to the council. To do this you would obviously have to leave the property (not permanently).

    You would need to make them believe that you have experienced or been threatened with violence.

    If the council believes that you are:-

    Homeless - The way you could qualify for this is that it is not reasonable to reside in your property as it is probable your continued occupation will lead to violence or threats of violence.

    Eligible - If you are a British citizen you more than likely will be.

    Priority need - If you have dependent children you will be in priority need.

    If these 3 criteria are satisfied the council will have a duty to provide you with emergency accommodation. The council can't refuse to consider a homeless application.

    However, as you already know what should and what does happen isn't always the same.

    Thank you marlieboy. I am going to spek to the solicitor on Monday. It's just the meantime. Obviously I have absolutely no faith in the police so who do I call? I feel like a sitting duck. The slightest noise has me on edge. And my young boy saw all this. I have no faith in the police. They broke into here and assault me and NOTHING is done. How does that deter a landlord? Have the worst headache.

    I'd go to the police station and say you want to make a formal complaint. They have to listen to you. Print out all the information that you can find that backs up your position and take it with you.

    Three incidents of police not knowing my rights. And then a sargeant telling me he's a landlord and the landlord can come in whenever. This DESPITE a hand delivered letter from the agent saying landlord wants to do inspection Monday. Police justify it by saying landlord not in wrong cos he getting screws over by agents too. How is that my problem?
    I'm scared because what do you do when police do nothing? If I'd gone into anyone's house without permission and hit them then I'd have been charged but cos he my landlord it's okay. !!!!!!
