Lost terms and conditions

I recently applied to my credit card company for a copy of t & c in order to check if I could claim PPI. Had a letter in response saying the t & c were lost and therefore the debt was unenforcible. They then went on to say that although this is the case I still have to pay or my account will go into default and they will take legal action. I'm confused...Is there a way to write off this debt? I'm already in default and paying token payments of £1 per month!

    Yes, you can write off the debt, as long as you are willing to make no more credit requests from any lender for at least the next 6 years.

    Can somebody please clarify why the debt unenforceable? I've not come across this yet

    Well paying £1 a month suggests this may not be a problem.

    Why would you need a copy of the T&C to see if you could claim back PPI?

    The credit card company can just regurgitate a generic terms and conditions to make the debt legal again.

    I don't think you are giving us the full picture here - please feel free to give us more information.
