Tesco Claim Rejection - help needed.

I have been helping my father out with a number of credit cards PPI reclaims and firstly wanted to say thank you to everybody on here for all your help and advice. So far I've managed to claim back £10,000 for my father and that's only on two of his 5 cards. I have worked out that we need another £18,000 to make him debt free. So looking good so far.

We have today received a rejection letter back from Tesco. It looks like he took the card out using one of those leaflets although he cannot remember as it was many years ago. They say he had the option
to opt out of PPI within the leaflet, Im presuming one of those tick boxes in the small print.

What i want to know is whether we have a case here? can we claim, or would taking it to the Ombudsman be a waste of time if what tesco are saying is true?

I plan to request a copy of all documents shortly paying the usual £10 fee but if what they are saying is correct and my father took out the card using a leaflet possibly received through the post etc as an application and forgot to opt out using a tick box in the small print is there any way around this and can we still make a claim?

Any advice would be appreciated.

    Why are you sending a SAR letter AFTER you have complained? That's the reverse of how it is done.
    The situation described by Tesco is a "non-advised" sale in which there was no contact with Bank staff. In this scenario, the complainant (your Dad) took out the credit card and attached insurance by filling in an application form of his own volition. He therefore mis-bought and so cannot complain he was mis-sold.
    A SAR will only confirm what Tesco have already told you (unless you believe they are not telling the truth).
    Little point in referring this to FOS either, although you do have that right.
