    Yeah its a odd and horrible situation, I live in Epping, and theres limited places to live around here or any of the surrounding places.

    I know, I dont want to dump my house mate into paying the rent again, however if I dont sort this situation out, I am on the streets, literally have no family still alive or anywhere I can actually go to, especially with all this furniture.

    Yes I asked about moving a dog in, thats not what this thread is about though.

    The landlord has accepted the months notice as he wants us out, but I just cant move anywhere in the 2 weeks I have left, feeling very helpless and stressed at the moment so apologies if I sound upset or misunderstood.

    I gave the notice to the estate agent, and the landlord accepted by text.


    When the LL accepted the notice did he agree to a 'surrender'?

    Personally I would give Shelter a call and get some advice on this.

  • As i see it, ignoring anything which was said between the landlord and yourself prior, you and your joint tenant gave notice to quit the tenancy early. This was then accepted by the landlord. Neither the landlord nor the joint tenant were obliged to agree to this. If your joint tenant had not agreed to end the tenancy, you wouldn't have been able to end it. If the landlord had not agreed to end the tenancy you woudn't have been able to end it.

    All 3 parties came to an agreement. You and your joint tenant offered to surrender the tenancy and your landlord accepted this surrender. I don't think there's any argument on these points. It seems to be reasonable to me, that if it takes both joint tenants agreement for a notice to be valid, it would need both to rescind it.

    Your joint tenant has unequivocally surrendered their interest in the property, as they have given the notice, it has been accepted by the landlord and they have moved out.

    As i read it, once the notice runs out you will have no lawful right of possession and the landlord can evict you without a court order as long as it is peaceful, though it would be advisable that they did obtain one.
