Problems with Virgin Active Gym- advice needed

I signed up with Virgin Active Gym back in March 2010, I can't remember under what type of contract but it was flexible and I gave them the 30 day notice period time and cancelled my contract with them in May 2012. I had no problem in doing it and the lady at my local branch reception also confirmed that it was done and if I ever wanted to join them again I was welcome. I don't use the bank account I paid Virgin often and didn't monitor it either. This year, in April 2012 I booked a consultation at my bank and the bank worker looked over the account and asked me if I knew who was Holmes Place No 2 who kept taking payments of £100 every month for the past 2 years. I had no idea who they were, the bank worker looked into it and said that Holmes Place was connected to Virgin Active Gyms. I told him that I was a member there 2 years ago for a month and then left them and haven't used any of their services since then. The bank worker then cancelled the direct debit and also asked Holmes Place No 2 for a refund. About 2 weeks later, I did receive the refund. But now I have been contacted by credit depth company who is asking me for £300 to pay Virgin Active Gym as they haven't been able to access my account for the past 3 months. I really don't know what to do, as when I cancelled 2 years ago, I gave them the notice period, also the lady at the reception said it had been done for me and nobody advised me that I have to go to my bank and tell them to cancel payments made to Virgin. I called up the Virgin Gym branch I used when I was a member 2 years ago and the woman looked it up on her system and said that the accounts manager has forgotten to put my cancellation through and she will call me tomorrow. I would really appreciate any advice on what I should do. Thank you.

    I wouldn't worry.

    It sounds like an honest mistake on their part and they'll almost certainly sort it out for you without any problems.

    At worst you may have to chase them up.

    If you've received the refund, Virgin have accepted that you've cancelled and they have been charging you in error.

    Contact Virgin (for your contract was with them) and insist they tell Holmes Place that the contact is cancelled.

    How did you inform them you were cancelling? Letter sent recorded deliver I hope?

    @ timberflake When I cancelled 2 years ago, I did it in person at the branch which I used and signed a paper on spot for cancellation given by the receptionist.

    And you got some sort of receipt to confirm you'd cancelled your contract?

    Holmes Place were taken over by Virgin Active who now run the company. Asfar as I know all Virgin contracts are for a minimum of a month and require 3 months notice.

    Check your original contract.

    And if anyone comes knocking for the money tell them you dispute owing any money and they will need to take you to court.

    I had a similar situation with Fitness First in a club in Northern Ireland a few years ago. Some debt collection company began ringing as they were requesting money even though I had cancelled by letter. My Mum was actually going to pay these people 'cos they were ringing and pestering me so much. Jokers...
