    Just to clarify one minor point raised earlier: although fraud &/or theft may have been committed, it's also worth lobbing false accounting (s.17 Theft Act 1968) into the equation.

    I'd suggest OP get copies to give them back up if the companies approach doesn't work out. You shouldn't be liable for any tax as you should be able to convince HMRC that these invoices aren't really from you (and aren't real at all).

    But has tax/NI been paid on your actual wage? Have you been given monthly payslips and a P60 at the end of each tax year?

    Agree with the above. has the OP paid any personal Tax or NI? if not, then yes, you could be liable.

    Sorry OP but it seems to me that you may have known about this setup a bit longer than a few weeks. 3 years is a long time in an organisation and surely you would have received P60's or been aware of P14's, company expenses and payroll issues somewhere along the line.

    Have you paid any Tax at all? can you put up a copy of your most recent payslip?

    I'm afraid Ignorance of the law isn't really a defence.

    Sorry if i'm harsh, something isn't adding up, perhaps we are missing a bit of info................

    If you have been given payslips for each month/pay period detailing the deduction of tax/NI, you do have some coverage. If your actual salary payments from him show these deductions in the sum you receive, then it is his problem for failing to report and pay the HMRC debts and he will be chased for it. I had this a few years ago where an employer had not paid my tax properly - I could prove on my P60 that I had paid it - it was the employer who had not passed it on, and was chased for it.

    If you do not have payslips detailing this, then you may have a problem, and must get in touch with HMRC immediately. You can ask for a covert investigation to be undertaken, and you can take steps to set aside a portion of your ongoing salary to settle tax and NI liabilities.

    You are expected to ensure that the deudctions have been made - by you or your employer. If a person if offered a salary of £12k per year and receives a full £1k per month, there is a reasonable assumption that they haven't paid tax.... do the numbers look like deductions have been made?

    If you have not been receiving these details, go to your employer and ask for payslips for the last three months - tell him you are applying for a loan and need proof of income. If he produces them now, you've got reasonable evidence that he intended to commit fraud using your salary and HMRC might be a lot quicker about sorting things!

    Talk to them - they are human beings and are often brilliant at helping sort situations.
    Some days, it's just not worth chewing through the leather straps....
