EESA help please

ss for the long post

My mum was made redundant over a year ago and was given some money as part of her redundancy package, my mum then split with her partner and had to set herself up with a new home.

I set my mum up with claiming EESA as she suffers from sever depression and has attempted to take her life several times. she was entitled to contribution based EESA and was receiving it for a year also she was receiving housing benefit for the same period it took some sorting out because of the money she had from the redundancy but we managed it and was starting to get her back on track with her mental health nowhere near what she was but getting there.

Then she was sent for a medical which stated that she was fit for work, which was a joke i was there for it and the report that came back was completely different from what actually happened :mad: so i sent in an appeal against the decision explaining point by point what was wrong with their report. Her money was stopped because of this report, but as i had appealed it i thought the money would continue to be paid while the appeal was held and when this didnt happen i rang them to ask why her money had been stopped they said because her sick note had run out (i had been checking we were sending them regulary but they hadn't recieved one) so we got a duplicate and sent it off, i phoned a week later to ask why they still hadnt sent her a payment and was told it was because of her capital (the money from her redundancy) so i told them there was no capital that it had all been spent setting up a new house, paying off debts etc but we were told they had to send off for some documents out of archive (the ones we had originally provided at the beginning of the claim) so we waited for that to come back when it did we were told that that wasn't enough and to provide them with bank statements from April 2011- April 2012, which i did they now say that is not enough as it doesn't show the capital, i said well it wont as it was spent.

her money was stopped on April 12th :eek: and we are still no closer to getting this sorted out she is desperate for this to get sorted as it is really affecting her now i don't know how much longer it will be before the stress of all this will push her to taking her life again. phone calls to EESA do not help as no one person is dealing with the claim i never get through to the same person i am at the end of my rope what can i do to get them to start paying her some money so she can at least have food on her cupboard??

i have been applying for crisis loans for her but she is now on her 3rd one and they have said they wont pay out anymore crisis loans.

    If she was made redundant in the last couple of years do you know if she was awarded Contribution Based ESA before the assessment stopped it? How long was she on ESA before it stopped? Edit just seen it was a year. If she has had a yaer of contribution based ESA she can only continue to get ESA if she qualifies on the basis of income and capital.

    Have they told exactly what information and evidence they want about her income and capital? Have you supplied it?

    yes she was awarded contribution based for a year which stopped at the same time as the assessment. everything they have asked for we have given to the best of our ability

    If it was contribution based then her claim has expired, she would need to claim JSA..
    Alternatively she could look at submitting a new claim if it was some time ago..

    How much was the redundancy package as this could be seen as deprivation of capital if the money went quick..

    You need to clarify with them what they want from you- phone them and back it up in writing. They will want to know what her current income and capital is and they will also want to know if there was any lump sum capital due to redundancy and what it has been spent on so start gathering this info to pre empt the request- bank statement showing the capital going in and statements from then to date plus any proof of where the lump sum went.

    we have given them all this twice but the stuff we have given them isn't enough they want duplicates of all the stuff we have given them already i dont know what else to do

    It's faster to give it again than to argue about having sent it already I'm afraid. You have to be pragmatic - just resend it- the archives take ages to send things through.

    If your mum was receiving CB ESA and was also receiving help from Housing Benefit then i can presume her redundancy was less than £16000.

    With tariff deductions for £16000 in savings the maximum is £40 per week reduced from ESA (income based) therefore still giving an award of £31 whilst appealing and her full entitlement to HB.

    The only thing i can think of is to ask to speak to a manager when you ring and put a complaint in by phone and back it up in writing.
    Forums can be/are a good guide to entitlement and it is good practice to back it up with clarification from the relevant department/specialist with written confirmation to safeguard yourself.

    she received 20k redundancy but it is all gone she isn't claiming JSA as she isn't capable of working atm her mental and physical health are not sufficient to be able to cope with it.

    she can't cope with opening her post, talking to new people, dealing with forms etc.
