Ebay dispute and Paypal claim chances of sucess?

Hi all,

Bought a Wii Play on Feb 19th. It's Mar 19th ... and no Wii Play.

Have emailed the seller and he replied at end of Feb apologising and saying it is on the way etc.

I sent a reply and tried to contact him again but have now decided to make a paypal claim.

Has anyone done one of these? What are the chances of success?

In the email I recieved from Paypal, the following text appeared ...

If we decide in favour you are eligible for $200 with a $25 processing fee.

Would paypal pay me that?

    Did the listing have buyer protection on it?

    The so called processing fee is rarely applied.

    Did you fund the payment with a credit card?

    On the listing it says 'seller assumes all responsibility for listing this item'

    I have aquired a paypal credit through items i have sold, so i used that rather than credit card.

    I don't pay for any protection on my paypal account, yet it claims in the email I would receive those amounts.

    So in effect, $200 and not $225?

    oh dear, not quite sure you understand what fay asked you, for large purchases you should ALWAYS use a credit card, if you have money in paypal you should withdraw it and fund by card, you are then fully protected and could do a chage back from your cc company.
    there should have been a symbol on the listing stating if buyer protection applied and up to the amount protected.
    you should be covered by paypal BUT if there was no buyer protection logo, all the seller has to do is empty his account and you will get nothing.
    is the seller still active on ebay? what is their feedback like? are they a business or private seller? how much was the wii?

    thanks for the reply

    the item was 35.00 plus postage of 3.00 so 38.00 in total

    their feedback was good at the time. all positive. they now have a rating of 120, but now have 4 negative feedbacks. i have yet to add negative feedback ... but will be sure to do so once it is resolved.

    the person has items for sale on ebay at present.

    His feedback is generally quite good, so it could be an oversight, missing in the post, or on its way to you now. He does say allow 10 days so it could be coming from overseas. There isn't any seller protection, but he seems to be selling regularly so you should stand a good chance of getting your refund if it doesn't turn up.

    Personally I wouldn't give up hope of it turning up in the next week or so. But leave the dispute running.
