advice please on getting my excess back?

My car was written off in December 2011, and the claim has been resolved (100% other party admitted liability). I had to pay £225 excess and 6 months later I still haven't had it back yet.
I've called my insurance company (direct line) and they tell me that legally the other party's insurance company is the one that must pay me my excess back and until they get their costs back (including the excess I paid) from the other party (Aviva) then I can't get my excess back.
Surely this can't be right? Direct Line took my excess so surely they are legally required refund it?
This has been going on for months now and they tell me there's nothing I can do but wait for them to get the money off Aviva...
Any advice you can give would be most appreciated!

As already advised by r65, you need to be chasing Aviva for this.
Write to them requesting this (and any other uninsured losses you have).0 -
