Hello, can anyone help with some information? My wife sent a SAR letter to M&S money,they have kept the £10.00 cheque ( i pressume they have banked it) and all they have sent is a copy of her application form and a copy of the terms and conditions for both accounts that she held but nothing else.

They say in their letter that was included:-

I HAVE CHECKED OUR RECORDS AND CAN ADVISE THE ACCOUNTS HELD IN YOUR NAME HAVE BEEN CLOSED FOR SOMETIME.REGRETTABLY,I AM ONLY ABLE TO PROVIDE VERY LIMITED INFO RELATING TO THESE ACCOUNTS.

However the two accounts were only closed in March 2007,with payments of over £6000 to clear them,are they not supposed to keep records for at least 6 years?

Any help will be appreciated

    Was one used to repay the other off?, if it was then use the account number you have on the agreement they have sent and put the claim in for mis sell and ask them to look for the other loan.

    No, there is no obligation on the lender to keep records for 6 years, just as there is no obligation on the borrower to retain records for 6 years.

    Thanks for the replies,amersall the two accounts ran at the same time,one was a credit card and the other was called Personal Reserve which was basically a loan.I have checked the copies of the application forms and allthough they are hard to read ( as they are photo copies of photo copies ) but the boxes for PPI have not been ticked so i pressume she did not pay any and so cannot claim for something we are not entitled to.It would have been nice to see the transactions incase it was added later but heyho thats it.Thanks again for your input
