Hi moneysavingexpert,
OK, so we used the template letters to claim back £2593 worth of charges.
Just received a letter from Abbey with a goodwill 'offer' of £1100, including any bank charges not yet taken from my account, which I know to be in the region of £500.
I will be contacting them in the morning to ask for the £1100 plus these charges - which if I'm not mistaken are still UNLAWFUL.
Confused.
What should we do about the bank charges incurred after the inital claim ?
Can we claim them back at a later date ?
Please help !
Please bear in mind that my run of bank charges started when thet took over a year to supply bank statements for a Council Tax Benefit claim - which we ended up losing because of the delay.

Have you entered your claim in the court system as yet ?
Re the goodwill offer - they will cancel the £500 pending charges plus give you goodwill gesture of £600 from the amount you are claiming...you need to write back to them and say thanks, I'll accept it as partial settlement but my claim will continue until you have repaid the full amount claimed.LegalBeagles0 -

I don't know if there are on here, I havent been here very long..... there are some on the consumer action group site but you have to register to access them (it is free)...hopefully EL or Twinkly or Nick will pop along and tell you where they are on here

Hey Alison - you can add those charges into your claim before you file in court - any charges that have actually been taken from your account can be added up to the day you issue the claim.

Response to settlement offer.
Dear Abbey,
Thank you for your letter dated 14/03/07
I respectfully decline your offer of settlement and request, one final time, that you return to me all charges imposed on this account, totalling £2592.53
In order to avoid Litigation against you, I am prepared to temporarily accept the sum of £1100 offered as partial settlement on the clear understanding that the remainder is paid within the next 10 days. Failure to comply with this request will result in legal action against you for full recovery, as detailed in my Letter Before Action.
A further £500 is due to be charged to my account on xx/xx/xx by yourselves in respect of penalty charges, and this will be added to my claim. I request that you cancel these charges and refund the ££2592.53 Abbey have already taken.
Alternatively I will be entering my claim in the county court on xx/xx/xx. At which time the total claim will total £3092.53 plus statutory interest under section 69 of the county courts act 1984, and court costs of £120.
I trust this clarifies my position and I look forward to receiving written confirmation of full settlement.

Its best to stick to negotiation in writing so there are no misunderstandings at a later date. When you set dates for deadlines stick to them.LegalBeagles0 -

I was elsewhere when this was posted but there arent any templates on the main article for a partial settlement letter. I've just popped into the 'suggestion' thread to ask Martin if this can be done. Its variable what people will need to write depending on their circumstances but if people are sticking to the templates then one in the same style of writing would be handy to edit where needed.0 -

put in the date you are giving them until to respond to your letter then file your claim on that date
