Old Debt

Please can you advise me!

I had a credit card at least 12 years ago and got into lots of debt - when I seperated from my husband we paid most of it off apart from this one credit card! it has been passed onto lots of different companys but I am in a worse situation than before. I was told after 8 years alot of bad debt is paid off (this is probably wishfull thinking on my part) but now they are saying they are going to pass it back and advice them to take further action???

I am a little confused as to who I am dealing with and who I am now paying (not barclays)

    If its been over 6 years since you last had contact with them its statute barred

    The first thing is to ask whoever is c,aiming the money to supply evidence of the debt, it's unlikely they'll respond.

    If they do then send them a template statute barred letter which is on he somewhere, if they continue to chase it is illegal.

    There has never been court action against you to recover the debt?

    In the last 6 years you have never admitted in writing to owing the debt?

    In the last 6 years you have never made a payment off the debt?

    If the above is true in the terms of the Limitation Act 1980 the debt is not legally enforceable in a court of law. Just ignore recovery attempts. Obviously, you don't want to enquire about the debt if it's statute barred because then the 6 years will start again from scratch.

    Also check your credit file to see what defaults are listed. There should be nothing listed for issues 6 years and over.

    Under debt collection guidelines, once you tell them it's SB and to poke off then they hold go away. If not then complaint time or just ignore them
