PCN - Where do I stand?

On 4th June 2012, I was issued a PCN by Town and City Parking Ltd, in a supermarket car park, which I contested with immediate effect on the basis that the signage was misleading and confusing.

The letter and supporting photographic evidence contesting the PCN was submitted to them and received on the 7th June, I ensured the letter was signed for.

I gave T&CP the requisite 28 days notice to reply to my letter and the challenge.

Today the 4th July 2012, I have yet to receive a reply to that letter.

Is there a finite time in law when they should reply by, and having not heard are they contravening any law, which governs parkling regulations?

    You are taking this far too seriously. It is a ticket issued by a private company who have no legal authority to issue "fines" or any other form of financial penalty. Read the stickies here and ignore them from now on, including any future threatograms.

    although, if i remember properly, now that OP has contested it, is it not slightly different, as they have now basically admitted bein the driver?

    The driver hurdle is a tiny one for a PPC to overcome.

    The two BIG hurdles which they will never overcome are:

    1. The charges represent a contractual penalty and are not related to actual losses (Dunlop v New Garage)

    2. The PPC, as it does not own the land in question, does not have sufficient rights to offer a contract to park with the driver. VCS v HMRC.

    The OP should cease all correspondence and ignore all future letters from the PPC or their debt collectors/solicitors.

    You can stand wherever you want - this is not a PCN and can be ignored, even though you have given creedence to their scam by contacting them.

    Check the forum sticky to see what you will get next from them and ignore them from now-on. :)

    You wasted your time - think about it, a Supermarket can't fine you!:rotfl:

    The 'parking agent' (scam company who have convinced the Supermarket they can do a job!) will reply. But it will be a 'no' because this is not a real parking ticket and there is no appeals procedure (they lied to you).

    You took a scam seriously but no harm done, read up on the forum to learn about this. Glad you came here. :)

    A 'Parking Charge Notice' is NOT a real PCN but a fake one.

    Just ignore it.

    The most that will happen is even more junk mail letters that you can ignore; you are just in the middle of a mail scam at the moment and you will soon get that template letter saying no. :p

    No private parking company (PPC) can actually issue a real fine or penalty. Nor can they affect your credit rating nor send a bailiff round without the small matter of winning a Small Claim in Court first! Won't happen. And in any case, Town & City have never done Court and won't start now.

    The ticket was correctly issued and your appeal has been declined !

    How do I know that, because you have an
    IMPERSONATION OF AUTHORITY

    Understand the impersonation, yes its good, in fact fools 6 out of 10 who get them YES the company are a real company.
    Q. Can they Fine/ parking charge you ?
    A. Only if you are daft enough to pay it
    Q. what if I ignore it
    A. They will make threats of fake court action, impersonate more authority such as fake debt collecting companies, fake solicitors all to go with the fake ticket.
    Q. can they really take me to court
    A. you can take anyone to a civil court for anything, but try proving it, at least 3 very good parts of LAW exist to say they can not charge you a contractual penalty, fine you as they have no statutory instrument of law, or invite you to park in the first place on land they dont even own, let alone claim damages.

    A. Yes hundreds and hundreds or the other 40%

    A. NO scammmers never just go away, they come back for more money in late payment charges and keep coming back until you do ignore them, so start at the beginning .

    no matter what its a scam a FAKE FINE,do not fall into the trap of believing its real,its not, so whatever,just ignore full stop, nothing can/will happen to you as a result of this, so where do you stand? exactly where you did before you recieved this loo paper.keep your money , do not part with it to a SCAM/FAKE FINE.
