Received wrong eBay item

Hi quick question please.
Bought a dress from eBay on the 25th june. Received a top in the post a couple of days ago and it wasn't something I had bought. Checked the sellers sold items who I bought the dress from and it is one of there items.

Ovibsouly mixed up packages.
Emailed seller to say I've got the wrong item and assume the other buyer has my dress, seller has got 17 feedback so as they are quite new suggested they cOntact the other buyer and we do a straight exchange.

Sent 2 emails and no response and wanted the dress for this weekend.
Do I open item not received case or not as discribed??

    Open a 'not as described' case - you will have to return at your expense by a tracked method - you will then get a refund. I would hope that the seller would also refund your return costs as it is clearly their mistake, although they are not obliged to do so. Feedback accordingly!

    Hopefully if you open a case they'll contact you, you can request their phone number & give them a ring.

    I would do as Hermum suggests before opening any dispute. It's very early days and I doubt you will get this sorted before the weekend by now.

    what about contacting the member who left the other feedback aswell, trying to find out if that is who yours was mixed with and co ming to an agreement?

    Even if you could make contact that probably isn't a good idea.

    If you both agreed to swap items you both incur additional costs.

    What happens if you send off your incorrect item but don't receive the correct item in return?

    It would only work safely if you are local to each other and can meet to swap and even that is dodgy. You just don't know who you are dealing with.

    Start a claim via the usual Ebay process and let the seller sort out their error..

    I agree with Avoriaz that the seller should be the one paying, but in practice it's often easier to broker a deal between the buyers and pay them. It's happened to me and everything went fine.

    However, it does require co-operation, and honourable behaviour, by all three parties. If any one of those is AWOL, it becomes very difficult. There's a thread started by someone else (BadgerFace) giving a different perspective.

    In general, I suppose if the seller is not responding, raise a dispute and get your money back. But like always I would make sure that the situation is irretrievable before you do that.
