Resigning due to stress will I get JSA?

I`m at present off sick with major depression and now a dislocated patella. I work at the family business I have had know support from the family and my depression is not getting better.

My Dr has suggested that I may have to have a op on the knee, all I get from my boss/father is when I`m coming back to work he see`s that their is nothing wrong at work, employee bullies me.

I`m off sick with a note and I`m wanting to resign to start getting better as I need to break ties with the family to start recovering.

Will I get JSA?? as if I leave without it, it will financially cripple us till I can start working.

    You may not get JSA if you leave without 'good cause'.

    Is this a firm large enough to have a policy on bullying?
    Have you followed that procedure?
    This would put you on a better footing.
    Have you spoken to your doctor about this?

    From the previous information i suspect that you are talking about contribution based ESA.

    This can be sanctioned for up to 6 months if you resign voluntarily.

    However, if you can show 'just cause' then you may not receive a sanction.

    Showing 'just cause' can be difficult and each case is examined individually.

    Just cause may, for example, involve your being unable to continue because of detriment to your health. If you are receiving counselling and your doctor urged you to this then this may be sufficient. (will need evidence of this)

    I think that Job Centre Plus may contact your employer (your parents) but am unsure about this. Hope others can help.

    Have you not been able to sort this out with your family?

    Had meeting last Tue, all they were interested in is when/if I coming back, told them my feelings and about other staff member, was told to put up with it.... they feel thats theirs nothing wrong...

    They are now paying me SSP instead of full wages and threatening to take my company car. They are bulling me into returning saying that I will lose my car etc.

    After speaking to my Dr he has agreed that leaving to recover from this is best.

    I have a meeting with CAB this Friday.

    Haven`t heard from any of them since, even though I was very distressed ..... supose that answers all the questions I need to break ties to recover
